    I work for my brother and he 1099 me but he tells me where to go and what time and he owes the truck and he say I'm independent contractor is that true

    NO you are an employee by the nature of you being told what to do.

    If you doubt that, then tell him in the morning you are taking the day off and if he says no, you are an employee.

    and never work for a relative.

    Yeah but if you're a lease operator out of Mega carrier they're going to give you a place to park in and give you the truck and some of them will offer discounted maintenance services by their mechanics on their property and their maintenance bays.

    So..... pass or fail, that test?

    Well, a L/O the trucks is not supplied by the mege. They are bought from a (usually) 3rd (ok, 2nd) party company. I/e One would get the truck from Prime leasing, Inc. and actually be leased to Prime transportation, inc.
    Offering discounts means nothing. The "owner' can still get work done anywhere, it's just tends to be cheaper at a Prime shop.
    As for parking, again simply allowing one to park at their terminals is different then requiring it.

    The biggest issue is when Prime offers benefits like health insurance. That typically means employee. But it's a balance thing. No one, (or two or three) items make it an IC or employee. It's how all the items are balanced.

    I take it you drive for prime? What do you end up getting per mile avg as an owner operator or lease operator on their loads?

    Nope, just using that as an example. Heck I just made up names. I "think" I've heard Prime leasing mentioned, but not positive of it. Doesn't change the example though.

    As for company leasing, Well don't. Go finance a rig and lease on to someone like Landstar or Mercer, etc....
