14 Hour HOS Question

    It think depends on the interpretation of FMSCA and the programming by the ELD provider.

    I have Transflo. True I get a violation if I don't take 8 in the sleeper, while taking a 10 after an earlier short break.

    But ... I did an experiment. Taking a 34 all off duty after an earlier short break and the ELD reset all my clocks. No violation for not taking 8 in the sleeper.

    I do understand. It can be difficult because it’s a series of this then that if this situations.

    That is why I asked the questions I did and why I requested that only answers to the specific questions asked be given.

    Being that most people here would like to help I knew that if I didn’t try to limit the scope of answers I’d be overwhelmed with information which would simply muddy the water and I would be more confused than before I asked.

    By asking the questions way the way did and attempting to limit the scope of answers to only those that pertained to what I asked I was able to fully comprehend one rule before moving to the next.

    Now I finally understand how the rule works.

    I’d suggest you do the same, but on a new thread. Not because I’d want to add another thread, but if others start doing the same in this thread then I think it would get confusing as to who is asking what. You would have all sorts of people chiming in with good intentions when in reality it doesn’t help you accomplish your goal.

    Remember the sayin ‘garbage in, garbage out’

    ELD output is only as good as is the written code that does the calculations. I spent 15 years in the IT field. I can’t tell how many times I had to “fix” crappy code because the person who wrote the original code was an outstanding programmer who could make programs do all sorts of wonderful things. Who on the other hand didn’t always quite understand the rules that dictated that outcome.

    Case in point. An excellent programmer creating the code to calculate any possible HOS outcome. If he doesn’t FULLY understand the rules then it’s impossible to write a program that can accurately give correct output regarding any possible scenario those rules could generate.

    I dont use it but you can experiment with it on your ELD if you know youre going to be waiting somewhere more than two hours. If you know you will be waiting more than 2 hours put yourself in sleeper instead of off duty while waiting. Then when youre taking your 10 hour put yourself in sleeper berth again. You should see you will gain hours back on your 14 after only 8 hours. Ive only used it once in 10 years and it did help when a dirty filthy money hungry dispatcher booked me on a load that required using split berth.

    I always put myself in sleeper anytime I think I’m going to be stopped for more than a minute or 3.

    But more important if one is using a Qualcomm is to make certain the box Combine with SB is checked on the main status page. If it’s not checked it won’t apply split rules while tracking HOS.

    That was part of the reason I was so confused. A week or so ago I was expecting to freeze my 14 hour clock but it didn’t happen.

    I called out ELD guy and asked him why I didn’t I didn’t hours back on my 14. Since I asked it that way instead of using the word freeze he probably thought I was referring to the drive clock and told me I had to complete a split to get hours back

    Then a few days later I noticed the box wasn’t checked. Still confused I posted the questions I did.

    Now I totally get it.

    A: No. A 10-hour off-duty period cannot be paired for use of the split-sleeper provision. At the completion of a 10-hour off-duty period, the driver has reset both the 11- and 14-hour "clocks."

    So it says that a 10 hour break that’s all off duty can’t be paired for use of a split sleeper, but that a 10 hour break that’s all off duty resets the clocks. Does that mean that as long as you don’t extend past your original 14 hour limit that 10 hours all off duty is fine to reset everything but extending it past your original 14 hour limit and not completing the second part of the split sleeper is a 14 hour violation? Because that’s how Motive logs it. Once you do your first break and later extend past your original 14 hour limit it shows red and says you’re in violation but the violation could be removed with a second qualifying period.

    Also Motive has no button to hit to let the computer know that you’re planning to split. So that’s possibly why it shows a violation until you finish the split. I’m on a different system now and you have to select split sleeper to let the computer know what you’re doing but I haven’t used the split with it yet.
