14hr violation due to split sleeper

    Your 2-3 hours showing up is from the period before your first off-duty break that extended your 14 hour clock. By taking 8 hours off in the sleeper, you completed your 10 hour break.

    Then what was the point of mandating ELDs in the first place? Officers can just as easily find a violation on a paper log page as they can on a computer screen.

    And those things sure do act like tattletales when they notify your company of any violations you incur.

    I am not sure. I just know in one instance in the ELD app I had on my phone the violation was highlighted red. Stuck out like a sore thumb. But I didn't use my phone to log anything because it wouldn't sync to the tablet for the ELD. On the tablet for the ELD it didn't show the violation at all. Seemed weird to me.

    A DOT cop told me that when they download my logs, they don't have any violations highlighted on them. That they have to look for violations. He said that the ELD companies added the highlighting violations as a selling point to market their products. But that the mandate only called for showing the same thing as a paper log would if the driver actually logged things as he really did them.

    I can tell you exactly what happened because it happened to me. Let me guess you did the two or three hour part first and then you went back to the yard or wherever you were going to do your reset and you went off duty. Probably logged out as well…It will put you in violation the minute you log back in because you didn’t finish the eight hour or seven hour sleeper portion. I know that defies all common sense, but that’s how the system is set up. You literally have to do the seven or eight hour second part of the split in the sleeper. It don’t matter if you take a month off. When you come back and login it’ll put you in violation. I view this is some kind of programming glitch because it doesn’t make any sense. But I can tell you firsthand that’s how it set up.

    It's not a programming glitch. It's literally how the law is written. For a split sleeper to count, it has to be 7-8 hours in the sleeper berth. No other duty status counts.

    Yes it's stupid, but it is what it is.

    It’s extremely foolish and very frustrating. Let’s say you’ve been out for two or three weeks running hard and you use a split to get back to the yard so you can take your days off. You literally have to sit there at the yard on sleeper birth status for seven or eight hours or you’re going to be in violation. You can’t just get in your car and go home. I guess if you lived close enough by, you could go on sleeper status and then come back the next morning and switch to off. Lol it’s just dumb.

    It does this because of the people that have a second job. It requires you to “sleep” before you can drive again.
    And you may be able to edit that anyway.
    On our system the only thing we can’t edit is drive time.

    Might not be legal but I use Samsara on my phone and could easily switch from SB to OFF at home….and I most certainly would before sitting at or going back to the yard.
