16 hour short haul exemption

    If I need to use a 16 to get home ... am I still legal to do a 2 & 8 SPLIT? Or must I take a full 10?

    If you are doing a split you are likely not not eligible for the short haul extension because you didn't stop at the same location for the last 5 days.....
    It requires the following conditions.
    1. Not used since the last reset or 6 days.
    2. The last 5 days have to be stopped in the same location. *No not the yard up the street vs. the shop, but the same location.)
    3. The regs actually specifically state a 10 hour break is required, but only before the 16 hour exemption.

    Here is the wording of the regs.
    (o) Property-carrying driver. A property-carrying driver is exempt from the requirements of §395.3(a)(2) if:
    (1) The driver has returned to the driver's normal work reporting location and the carrier released the driver from duty at that location for the previous five duty tours the driver has worked;

    (2) The driver has returned to the normal work reporting location and the carrier releases the driver from duty within 16 hours after coming on duty following 10 consecutive hours off duty; and

    (3) The driver has not taken this exemption within the previous 6 consecutive days, except when the driver has begun a new 7- or 8-consecutive day period with the beginning of any off-duty period of 34 or more consecutive hours as allowed by §395.3(c).

    If you lay over one night in the week you can’t use the 16 hour rule

    No. You would have to had started and returned to the same location, on your 5 previous shifts.

    Ok. I have been local and had a 34. Today i worked 15.5 hrs and took a 2hr break during that time. I didreturne to the yard. Can I log 8 hrs in sleeper and go? Or must i do 10?

    So if you had a layover one night you couldn’t have got back to your starting place right

    Have you parked for your 10 hour break break in the same location for the last 5 working days? Including today?

    i say this all the time with threads like this but all this math and figuring out regulations sounds more tiring than just driving the #### truck, but i get it, keeping people in busyness is the best way to control a society. lol

    I guess it's too late, but, no you can't take only 8 hrs. , You have to to take 10. 8/2 splits are only for otr drivers.

    This is 100% factually wrong.

    Oh, it's most useful for OTR drivers, but there is nothing in the regs that state as such. I can see scenarios where it would be useful to "local" truckers. At least local truckers that log legally as in actually in the sleeper and not off duty at home.
