4 days layover pay

    Look when you became late because of the one drop, you should have called the broker and told them they need to get this unloaded when you get there.

    A holiday weekend, $1000 a day or let them find a way to get it unloaded.

    I did call right away, they said there will be no problem with new appt, second delivery was 4 hours away. A few hours after that conversation they sent me email with new appt for Tuesday.

    $1000 sounds unrealistic, they offered $150/day when I was asking for $350

    Legally I can hold the load until they send me a new confirmation with adjusted layover rate...

    I guaranty you there are not just 1, but multiple warehouses in the area that will gladly do business with you.

    Under the Uniform Commercial Code, U.C.C. Section 7-307(1), a carrier has a lien on any shipment tendered to it until freight charges on that shipment have been paid. That is, it’s within its rights to hold the shipment and refuse to make delivery until you’ve ponied up what you owe it for moving that shipment

    $1000 is reasonable. It is their screwup if they said it will be no problem and it is. You're in business to make money, not give your services away .... right??

    Edit ... this part didn't get posted ...

    If my drivers get there and they won't unload him/her, it is considered a refusal and the broker is told it is a refusal right away. We have maybe five a month like this, and out of the five, two are usually unloaded before we send the bol to the broker with the words "REFUSED DELIVERY" in big black letters, the other three are always sent somewhere else.

    That is correct. In the past I got paid what asked, but this time the broker is being ridiculous with the price. Interestingly enough I found their company agreement and they are charging shippers/receivers almost $200/hour for delays yet offering me $150/day during holidays.

    Would you keep the load until they agree to pay appropriate amount putting it in storage or unload and fight after? I do not want to unload without confirm detention $$ otherwise they won't pay anything and I don't think labor department will make much of a difference.

    It's ridiculous that there a no regulations that would protect a driver in ths situation and spell out how much money they need to pay...

    Depends on how tuff you are. I drove for a guy years ago who was out there , in the mental sense. He got into a fight with a bigger carrier and confiscated 3 of there trailers. For months and months those 3 trailers sat on his lot all chained together. Cops came out. They did nothing , said it was a civil matter. It went to court .... that’s when I left the company. I remember those trailers sat there for a very long time.

    The broker jacked you around for 6 hours on purpose knowing it’s a holiday weekend and he was about to be out the door and you are stuck with whatever he decides to pay you... this is gonna be a lesson you probably gonna learn the hard way..

    Even if you paid $500 out of your own pocket for storage and redelivery and they paid you the full rate con you would be ahead. Although they should have paid that bill themselves and been reimbursed by the customer. That way it’s off your truck and won’t lose business. I’d probably been making calls myself to find a warehouse and then out the two in touch.
