I totally agree with this! Sleeper berth is ONLY imperative when you are doing a split break or driving team! Other than that what freakin difference does it make? Ugh! This crap is getting so ridiculous!

    I didn't post this .... ok?

If I am in the sleeper, it's sb on the log. If the truck does not move and I go into the ts, or walk across the road for a meal, it is still sb. If I buy something while in the store, it is still sb. Now if I get into a car, go get something to eat, it is ... off duty.

The cop is being a prick, he could have let this go with a warning but didn't. I've gotten dinged like this with drivers when we first got elds and we all talked and what was posted was suggested by some mysterious traveler who posted it here but it wasn't me

By the way, cops can't prove anything. Unless there is serious abuse by the driver and constant correctional actions taken against him for his violations, what that person posted here in this post would not be an issue.

Worst of all, is the driver had no gain by forgetting to go to SB. Didn't affect his 11 or 70.

Are we required by law to show a post trip? I always got different answers. So I show it.

We are our own worst enemy. As a former officer I will tell you don't give dot anything more than u have to. They can ask u anything they want. U say I loged off duty because I was off duty. You don't have to give anything else. If they write. U a ticket they have to prove you falsified your log. Same if you log sleeper. If they ask if you were in you sleeper for 48 hours you say yep and no more. Let them write the ticket and prove that you weren't.

    The driver should fight it.

    Rule 395.2
Since 2012 (?), it has been legal to log off duty inside a PARKED commercial vehicle.
