Thee Ed company I work for says they are a 70 hour 8 day operation. my question is they work us 70 hours Monday thru Saturday (6 days), then reset us on Sunday (day 7) then start the process again. I see it as a 70 hour 7 day operation. Is this legal?

Did your CDL school not cover hours of service?

Sure it is. Why would it not be?
If the motor carrier operates 7 days a week they use the 70 hour clock, if they don't they use the 60 hour clock. Note it states motor carrier operates a CMV everyday, NOT your terminal. Even LTL's tend to operate every day of the week if for nothing else, the line haul portion.

If you ran hard at any OTR job you would do much the same thing, and it would be legal.
You are never going over 70 hours in an 8 day period, so it is legal.

It sounds like they run you hard for the week and then you take a 34 to reset your hours.
If you don't like the working conditions you are always free to find something more to your liking.

Personally, I find working like that is very taxing.
I would rather average my hours so I never have to do a 34, which means an average of around 8.75 hours per day of combined on-duty and driving time.

To me, that is the best way to run. I love to run out my 70 then take a day off to do laundry and not feel like I am being a slacker.
Running recaps is what kills me. I just cant stand it.

And that is the wonderful thing about this job.
    Do it your own way.

If you get the loads to cooperate ! I say thats my favorite way to run but I think I had about one three month stretch ever to where I could make it work like that.

I drive for a small outfit. We generally run only Mon-Fri, but several of our drivers do 68 - 70 hours in those 5 days. Every single week.

Not me. I'm old, so I'm happy with 60 hours, especially in winter.

Some loads make me compromise, but with most I can do it like I like.
And a pplan that comes in with wonky times I simply ignore or refuse.

My aim is not to run hard, it is to run consistent - but on my terms.
If I can not enjoy my working environment, it is not worth working there at all.

It sounds like the OP is not enjoying the job.

Perfectly legal... Not using more than 70 hours in an 8 day period. A 34 hour resets that 70 hours and 8 day period. I do that on a regular basis.
