8/2 split, can a company ban using it for a LO?

    Can a company ban the 8/2 split if the driver is a lease operator?

    Isn't the 8/2 split more like an option rather than a regulation? 10 hours is mandatory, but 8/2 seems not mandatory just a option. Seems they could ban it. I'm not sure just reading between the lines.

    Yes, the company can make any rule that they wish, and you are required to follow (to keep your lease) as long as it doesn't go against any federal, state, or local regulation.
    You run under their authority you are required to play by their rules.

    I would think that if the option is in the regulations, it would be a part of the regulations.
    It is an option within the regulations that we can choose to use if we need or want to.

    But TankerYankr is right. The company can make any rule they want to, as long as it is within the DOT requirements.
    Banning the 8/2 split doesn't really violate anything.

    The company has absolutely no control over your logs! They are your hours of service: totally your responsibility! You are the owner and operator of your hours of service!

    A company can tell their drivers not to use the split sleeper berth.

    And if the driver does it any ways then the company can punish that driver.

    Ok: but, I think that they have the right to tell you to run legal and that’s it: federal law says that the driver “owns” their HOS.... but; everyone seems to interpret everything about these things differently......
