A Few Questions From 10 Year Driver

    I was terminated from a company when I had my very 1st preventable accident in over 10 years of driving, I was truly shocked by that. After they fired me they hired me an attorney to get the ticket I received dismissed. That will happen in a couple of weeks.

    Will that be on my DAC report and MVR after ticket is dismissed? I'm going to be looking for a new job after the ticket is removed and I'm not sure what I'll be required to say. If it's not on my MVR/DAC I shouldn't have to mention it correct?

    DAC yes, MVR unlikely depending on what is done with the ticket. And yes, you have to mention it because by law the company you put an application in has to check your "safety performance history" and "drug testing history" from your previous employer. Your previous employer has to mention both to be legally complaint.
    All DAC does is make the legally required information easier to get as it's all in one spot. It doesn't mean that if the company doesn't use it they don't have to follow the law.

    Now, if you can give us what you were fired for, location and type of work preferred we have a poster here who can send you in the right direction to get a new job.

    Wreck must not have been too awful, since the company hired a lawyer for you to fight the ticket.
    Then again, maybe the company did that to protect itself and using you as a cover.

    New job won't be hard to find though, especially living in Atlanta area.

    I'm no expert on DAC but doesnt the company report to DAC? If so, considering the fact that they hired the OP an attorney to fight the ticket, I wouldnt think they'd report it. Since the only way it can get on your DAC, & I highly doubt the company will report it, it shouldnt be on the DAC....

    Am I correct???????

    Thing is, if a 10 year driver for the company got fired they either were looking for any excuse to get rid of him or the wreck was bad. As they hired the lawyer my guess is it was bad. Injuries at least, likely even a fatality. In either case they will do everything they can to cover their backside. Part of that would be adding to DAC to make themselves look better to a jury.

    Now if they were just looking for an excuse they unlikely will so as to keep the driver from pushing back and taking them to court for unfair firing or whatever. Heck

    The Company is assigning you an attorney to protect themselves against any lawsuit that may follow. You may want to hire your own attorney to watch the companies attorney, to protect your best interest.

    I'm not sure about what it will be on after the attorney deals with the ticket.

    The company said I was fired because my safety clearance was revoked. Truthfully, I believe it is personal. The terminal manager is not very professional and we didn't get along very well. I spoke to people after the accident within the company that didn't know I was fired. Only because I was stalked for 3 years my phone is setup to record all phone calls (Georgia, legal). I have a recording of the call I received from this person firing me. I never received a termination letter or discharge paper... whatever you call it. In the call I'm fairly shocked asking them why. No history, no warning? It's all there. I also have a recorded call with the safety person assigned to me and she calls the termination ridiculous and says she never had a problem with me.

    I filed for unemployment just to have some money coming in to get my bearing and find a new job that was with a good company instead of rushing into a job but the GA DOL denied my unemployment claim saying I was warned about this. I have never had a traffic accident that was my fault in over 10 years. There have been a couple accidents but they were all caught on video and the other party was ticketed for causing the accident. I did rub a pole in a lot but it wasn't a moving violation and no other vehicles were involved.

    The accident I had was actually in my opinion caused my nature. There was a flash flood and the driver in front of me hit a wall of water stopping them immediately and the water wiped the highway in such a way that I lost traction and hit them from behind. Not too severe but there were about 5 accidents that all happened at the same time in both directions of the highway. Everyone that showed up said there was nothing I could have done.

    I can't afford it. I would like to have an attorney just to appeal unemployment denial if they would take part of what I got instead of charging me.

    No fatality. One person in the car. It was hit from the rear by a big truck. Saw them talking on the phone before they requested an ambulance. They are going to try and get what they can.
