If it passed the senate and the president signs it into effect then we will have the ABC test nationwide. The owner operator model does not pass the B test.
Keep in mind that the trucking industry is only one out of the many industries that the AB5 and PRO aimed at. They are targeting at the employment classification of contractor vs employee in the general job market. There are industries, such as insurance, real estate, etc. are exempt from the ABC test and have separated rules for the classification.
I think it is difficult to stop it unless the president veto it. Again, the AB5 and PRO aim at the general job market, not a specific industry. I hope that the trucking industry can be exempt from the AB5 and PRO.Vitkouski Thanks this. -
