A strawman, from start to finish. The driver was going less than the speed limit (supposedly) so what does it matter if it were chicanes (which it wasn't)?

I don't recall the slower than traffic in the 5 points of the Smith System, when I learned it years ago. I'm with you in that I'd rather be slightly overtaking traffic, moving the 'action' in front of me, rather than behind me.

Without going back and wading through the vitriol aimed at one another, I could not locate anything that could have pointed to a load shift. Was the load loaded and secured properly?
Know the road.....know the load. Sounds like perhaps (PERHAPS) both may have been contributing factors. -

In the matter of whether or not the construction company can be held liable, I stand by my statement that you don't know what your talking about.
I have been to job sites where the construction company was supposed to have obtained permits to close the main street, downtown in a city of 150,000 people. Turns out they never bothered to get the permits but closed the street down anyway.
As I mentioned above I have seen a drunk driver sue a county for his crash and get money because the county didn't maintain the road properly.
If I am pulling a 14' wide load and 4 wheeler clips the corner of the load as he is passing me, spins out of control and kills himself, do you really think it matters if I am properly signed and following the speed limit if I have no oversize permit?
Being the "crusty outlaw 4 million mile trucker" that you are, I know that you know it all, and I know it must pain you to admit you're wrong, but keeping all of this in mind, do you not think it's possible that the construction company can be held liable?

BTW, i believe we were discussing if they should be liable not if they could be liable. I can fall on a discarded Coke can and there will be a lawyer somewhere to make the case that Coke is responsible, in the lunacy of our current legal system.
