Call a lawyer but I would also track down the insurance company who covered the carrier at the time. They should still be legally required to cover the costs since they provided the coverage at the time of the accident. Nothing to lose by trying, right?

It should not matter if the company is out of business. If they had insurance, in good standing, at the time of your accident, the insurance company is responsible. That is what insurance is for. The only way you can become responsible is if there is proof of some form of negligence on your part. And "oh snap, I screwed up" isn't in itself enough to determine negligence. If you were stoned, drunk, over hours on log, or driving recklessly, then you'd have an issue. Lawyer up. A good lawyer should be able to make short work of this situation for you. Or let you know in short order if you are fixing to get shafted.
Well Mack, how can I put this If you take the lost time involved, the hassle of traveling, the possible loss of money and the chance that if you have to pay for this and it ends up into a collect by any means situation (garnish wages or seize assets), then a lawyer is far cheaper than a few years of BS.
