    You are about to get "home-towned".

    Usually, whoever files a civil suit first, wins. Get a lawyer but be prepared to settle... it's cheaper.

    I spent $100k trying to fight off a con-artist ##### in Van Buren county up there in Michigan. The whole ####ing court was crooked.

    My consolation prize is that she now resides in the Women's Huron Valley Correctional Center for killing her husband. Karma is a #####.

    If you get a notice to appear in court, better show up or you automatically lose. Hire a lawyer.
    Are you a member of www.OOIDA.com and if not, maybe you should be. They sometimes can give good advice on matters like this.

    Call a lawyer but I would also track down the insurance company who covered the carrier at the time. They should still be legally required to cover the costs since they provided the coverage at the time of the accident. Nothing to lose by trying, right?

    Most lawyers will give you a free consultation, see one, preferably in the County where it was filed, there may be some bizarre law that allows them to sue you there, not where you live. You need to see an attorney ASAP.

    Oh my god don't be so cheap, get a lawyer to protect yourself first and then worry about going after the owner later,

    What is with people who don't want to do a thing to protect themselves?

    It should not matter if the company is out of business. If they had insurance, in good standing, at the time of your accident, the insurance company is responsible. That is what insurance is for. The only way you can become responsible is if there is proof of some form of negligence on your part. And "oh snap, I screwed up" isn't in itself enough to determine negligence. If you were stoned, drunk, over hours on log, or driving recklessly, then you'd have an issue. Lawyer up. A good lawyer should be able to make short work of this situation for you. Or let you know in short order if you are fixing to get shafted.

    Well Mack, how can I put this

    If you take the lost time involved, the hassle of traveling, the possible loss of money and the chance that if you have to pay for this and it ends up into a collect by any means situation (garnish wages or seize assets), then a lawyer is far cheaper than a few years of BS.
