If you read the IRS pubs regarding incidental expenses, your wrong. I based it on IRS Pub. 463(2014) and "The IRS Meaning of Ordinary and Necessary Business Expenses", from the Accountants CPA Hartford, an article I found online. In the spirit of the publication you are correct, what I was trying to articulate is that as you are allotted a per diem to cover food expenses while on the road (food which you would purchase at home on your own if you were home nightly). The expense you incur under the flat rate per diem per the special rules for those under DOT HOS expands to cover those expenses without having to show receipts for them. What I was trying to articulate was that you cannot deduct them again as they are already included in your per diem allowance.

My final thoughts on this discussion. Two weeks ago, received the final updates from the IRS Appeals office, my total amount owed, with taxes, penalties and interest is $2,056.49, more than a 50% reduction from what I was originally told I owed. It took almost 3 yrs to resolve this, as I received the original notice of Audit in Dec. 2013. Of course I cannot pay the money owed at this time, I'm getting ready to draft a letter to the IRS explaining my current financial status due to my recent cancer diagnosis and surgery, as well as 6 to 8 weeks of time off work, in order to work out a deferred payment, a reduced payment, or a delay of 6 to 8 months before any payment is due.

Use form 9465 and submit with your installment plan. All are usually accepted.
