What did you fail from? Was it just shifting or something else.

One of the exceptions in the bankruptcy laws is school debts. So no matter what if they force the issue you will have a problem. If they secure a judgment your subject to have your wages garnished till this debt is paid. My advice is to see if you can work out a reduced amount and payment plan. Stay on top of this because it has the potential to bite you on your backside.

If I'm not mistaken, my truck driving school debt could have been discharged in bankruptcy, because there was no "student loan" involved, just a promissory note. Federally backed, traditional student loans are not dischargeable. Still, it was not worth it.

I know 2 guys that did not finish their year. One was fired another quit and could not get the new company to assume the payments. Both went to school at C1 in Indianapolis. Both tried to discharge both were told the debt was not dischargeable. Its my understanding if my memory serves that one of them C1 actually filed an objection and it was granted by the judge. I'm not an attorney I don't know anything except what I am told and see. If you do decide to go the bankruptcy route make sure this debt is dischargeable.

It's not a legit education loan so bankruptcy decision is up to the judge.

That said, my advice is this to all.

If you are in that situation, then document it. The time, date, place and the who said what when you make a written request. Yep written, not verbal. Then if this happens to you, tell them talk to your lawyer about collecting the money because they are supposed to train you to pass the cdl test, and that is a breach of contract.

He did pass the test. He has the CDL. But he did the OTR training in an automatic truck (which is stupid, and he asked for a manual). After that, they put him in a manual, and he failed their road test (I would have too with no experience shifting). So they fired him. Now they want him to pay for the school.

Wow, good info man. C1 in Indy is where I went. So it probably wouldn't have made a difference anyway then. Thanks!
