Alcohol prohibited from trucks during down time?

Also there is a difference between state law and federal law. As per federal reg 382.201 that states no driver shall report for or remain on duty who has a alcohol concentration of 0.04 or greater. But you the driver also have to go by the laws of the particular state that you are in. States have the right to make stricter laws than the federal government. They just can't make them more lenient than federal law. Case in point North Carolina the state that I reside in has a ZERO tolerance level. 0.000 In other words you might not be breaking federal law, but you could be breaking state law and are subject to be charged in that state. Scary right. So drivers be very aware of the laws of the state you are in. I learned of this in school just a couple of weeks ago. Courtesy of the North Carolina Highway Patrol.

Back in the day (1980's) the rule for pilots was "8 hours from bottle to throttle". May have changed, or any airline may have stricter standards.x1Heavy Thanks this.

Ya, sorry if anyone inferred that I meant the FMCSR overrode any state, local or company regulations. Most companies don't allow any alcohol in the truck at all, and even though it is legal federally and most states, they don't even allow firearms. It prolly is for insurance reasons. Either way, cover yer butts if you plan on doing either by doing a LOT of research to comply with all laws and company policies.

It is still 8 hours. I was just thinking they had tougher. Must have been a company rule or something I had read.

When I was in the U.S. Air Force was 12 hours before flying. BTW its a bad idea to have/drink booze in the truck. I can see a problem. A Driver just finishes a beer and some yutz hits the parked truck, wham he/she is in deep dodo because he/she is on duty without the 4 hour difference. Same thing after going to a bar and then to the truck to sleep it off. Also in some states if the keys are in the ignition and you have been drinking you can still get a DUI, even tho you are not going anywhere.

Not so, if you're caught sleeping in the vehicle after drinking you may be charged with DWI. Arizona is one such state where you cannot sleep off a drunk in a vehicle when you have the keys.
