Alcohol question

    I don't buy anything from the duty free anymore, hardly worth it with the exchange today and I don't drink much anyway. Now I only use the duty free for depositing the kids at the pool as needed.
    The duty free at buffalo used to accept cdn and usd at par even after their money surpassed ours after it's brief time where it was below our money. In those days I was doing 3 rounders to pa or nj per week. I took full advantage. Being a cash man I always bought a bottle and paid with a cdn 100......and they always gave change in usd......basicly making the bottle free. Lasted about 6 months before they changed it so it didn't matter which you paid with. I deposited every bottle in my car at the yard before I left for the next round. (Did a bunch of rounds before going home for a while)

    You guys are trying to split hairs in justifying being drunks.

    Sorry if that is harsh but if you have not been relieved of duty, and are out of the truck without returning to it to fulfill hos requirements like a 10 hour reset, you are in control of that truck.

    That's how all fifty states define it and why the fmcsa regs are written that way.

    Just to play devil’s advocate, if you are out drinking, and want to sleep it off, what are you supposed to do with your keys? Throw them in the bushes and hope you find them when you sober up? If you are by yourself, you can’t have your keys on you or in the car, your options are limited.

    Best thing to do is not drink, then this whole thread is moot.

    If you can’t go a OTR stint without having a drink, you may have a problem.

    But with the 70 hour rule drivers will average working 8 hours a day, that’s plenty of time to go out to a bar and actually socialize, yes actually talk to strangers, then walk to your bed and sleep it off.

    It beats sitting quietly in the truck stop lounge watching CSI.

    Yeah, its not a good idea. I don't drink anymore. But if I did and found myself in a rare situation where I didn't have money for Uber... I'd rather sleep in my car, with my keys behind the tire, than drive home or sleep in the gutter.

    All I said was that option was legally there. I didn't say it was desirable. :D

    Found myself in a potentially sticky situation back in the early 90's. Consumed a few to many at the club. I had decided that my house wasn't far away, I would leave my vehicle in the parking lot and hoof it. Halfway home the police roll up on me. They start questioning what's what, I explain what I'm doing well that's just not good enough for Dudley do right. Deputy dog starts in telling me he is running me in for public intoxication, I'm like wait what, I'm walking home to avoid breaking the law just to go to jail anyway. the older officer stepped in and just told me to carry on and have a good evening. Some times you can't win.

    Just put booze on the cat walk. And if your getting drunk in truck close your cab curtains. Even though this is stupid. I see bottles of beer all over the back of truck stops.

    technically, if you don't have a BOL for it, you're wrong

    § 392.5 Alcohol prohibition.
    (a) No driver shall -
    (3) Be on duty or operate a commercial motor vehicle while the driver possesses wine of not less than one-half of one per centum of alcohol by volume, beer as defined in 26 U.S.C. 5052(a), of the Internal Revenue Code of 1954, or distilled spirits as defined in section 5002(a)(8), of such Code. However, this does not apply to possession of wine, beer, or distilled spirits which are:

    (i) Manifested and transported as part of a shipment
