Yes it is, he posted his mvr, not the dac, so he has to go to the court and have the mvr corrected.

At this point, I don't really understand the OP. It looks to me that the OP has confused MVR, PCP, DAC, and hireright. That first screenshot looks more like it came from DAC, I don't know of many state MVRs that have fair credit reporting warnings in them. I am starting to agree with chinatown.

Do yourself a favor and pull your own MVR directly from Florida and see how it actually reads. The HireRight report will 'convert' to their format which is where that hazmat/CDL "Y" is coming from.
Also, the refusal may have been thrown out but the 1 year suspension is what is showing and unfortunately, that is what shows the details on the refusal.mikewu9900 Thanks this. -

These are from hire right. One says mvr, one says dac. I will pull from FL to see. But after an hour on hold and talking to them yesterday, they said their report doesn't match what I was saying with CDL y and Hazmat y

OK, allow me to change that comment to add some clarity. DAC is an information aggregation service. they can only report what is provided to them. If you had an accident and was driving a CMV, CDL or NO CDL and there is no record of it, then that is because the information was not reported to DAC. People sometimes have a tendency to classify a CMV as one that requires a CDL to operate. A CMV is ANY vehicle operated commercially interstate with a rated weight of 10,000 or more. Yes DAC does hold information on none CDL driving information. In fact, there are some companies that will report time driving a yard truck to DAC.

Im afraid to go deeper into this situation. At first I was hoping you just had a plain car license, but apparently you have had a CDL with these on hand.

If you did have a CDL that was valid the day you "Refused" testing while also under a Hazmat Load, it's probably going to be 5 years or so before you get back into this.
Be very careful here. If this happens again, ever with a CDL, you could be banned for life from Trucking. I have a explicit list somewhere in the previous postings that show exact disqualifications and how long after how many strike counts. -
Neither of these are your DAC report. Your "Drive-a-check" report comes from reports by Carriers and has your tenure/accidents and sometimes drug and alcohol. Your first attachment is HireRight's conversion of your Florida MVR. Your second attachment is your PSP, Pre-Employment Screening Program, which comes directly from the FMCSA and has your roadside history for 3 years and DOT recordable accidents for 5 years and the carriers that were associated with it. Yours is obviously bland since you haven't been driving.mikewu9900 Thanks this. -
