Yellerhammer its hard to say, but I would say its the same eitheir way. The reasoning being that is you are a professional driver and should know better. If I want a beer or two I drink at home or get a hotel room.

The point was made in another thread somewhere that even off duty, you are still in the truck and can be charged with DUI even if the truck is parked. #1) If you are idling to keep warm or cool, you are in control of the vehicle. #2) Even if you are not idling, there may be an emergency situation where you would need to move the truck. Example, perhaps the truck next to you catches fire. Not common, but it is possible.
Many companies restrict the use of alcohol even more than the laws do. Look at your drivers manual, or call your safety department. They can clear up any questons you have about whether you can or can't. There are drivers who get away with drinking beer in their truck. Is it smart? No.
Put a scale in front of you. On one side is a beer. On the other side is your job.

I asked this question not talking about drinking a pint of vodka or a case of beer, I like to drink a tall boy or two before I go to bed after a long day. Its not like I am asking about snorting coke or smoking crack! My question was really about whether or not it is legal to posses it/drink in the cab. Two beers would not put anyones safety at risk.

There are a lot of drivers out there that like to take pictures with their cell phones . Some of them would love to have a picture of a driver getting in his truck with beer and post it on the internet and identify the carrier .

Thank you Hitman. I thought it was common sense really. As to the remark about beer vs. crack. Being impaired is just that being impaired regardless of the method used to get there! Please I am married to a man that loves to toss a couple back after a long day too. But he realizes he is in control of a machine that is deadly if mishandled. How does he deal with the urge you ask? He lets me know when he will be home for 3-4 day hometime and I make sure the beer cooler as a case min in it and he toss back all he wants the first night he is home and maybe even night 2 if he knows he will be here for 4 days! Just use a little common sense and be responsible for yourself and the safety of those on the road around you that can't win the fight w/ a big rig!

Well, what happens if you have to suddenly move the vehicle because of some unforeseen event.
Truck catches on fire.
Truck next to you catches on fire.
Hazmat evacuation.

I just spoke with someone who has a CDL and went thru a roadblock here in GA this weekend. He was driving his own car and blew a .043. No arrest was made and he was free to go so it evidently doesn't apply in a non-commercial vehicle.
