Well these are all extreme hypothetical situations but in that case, I'd toss the keys to another driver and have them move it. Off duty means off duty. So what if you're at home smashed out of your mind and the truck stop calls you and tells you the truck needs to be moved? I'd tell them call the tow truck and call the company. Their problem not mine.

So then drinking in the truck could be handled the same way

Kinda hard to get a DUI sitting in a hotel room.:biggrin_2554: The keyword being "IN" the truck. If you're not in it, you sure as hell ain't driving it. Unless you got Mythbusters to rig up a remote for it lol.

But my point is morally there is no real difference and coming down on a guy for drinking during his time off isn't fair
    His truck is his home

Oh I agree but I know better than to drink in the truck. As much as I'd like to sometimes after a long day. I wasn't coming down on people just stating the most logical and smartest remedy, although a bit costly but better than being unemployed or jailed.

The simple fact is that alcohol is NOT allowed in a rig unless it is part of a manifested load being hauled. Grabbing a 6 pack or a bottle of wine and stashing it in the truck is against the Fed regulations.

Another issue is many businesses that have licenses to sell beer and wine have restrictions prohibiting consumption of alcohol on the premises . If a fuel stop sells beer they would not knowingly allow you to drink it in your truck .

I used to have a few beers in the truck after runnin all day, but I was sittin at the pilot in knoxville one time, and witnessed an accident along with the guy right beside me, I jumped in the bunk, Cops came, and the guy next to me told them i saw it to. they beat on my door for 2-3 minutes wanting a statement. I didnt come out. scared the bejesus out of me!!

I have seen truckstops with bars right next door if not in the same lot. The Investment Club in Indy comes to mind right in the same lot with the Pilot and I remember a place called Stoney Ridge in OH that had a motel and a bar as part of the truckstop. I have a good story to tell about that place but can't put it up here. Or the Wild Wild West in Las Vegas. There is a place in WV I think with a strip club right behind it and one in MS too with the same setup right off 55.
Lots of places sell beer and they might have a sign up that says no you cant consume it here but they know what you are going to do. I know its illegal to have it in your truck but so is speeding and some of the logbook stuff that goes on. Sometimes I can't go to sleep, a nice cold beer or two takes the edge off and I get my rest. Just don't make a spectacle of yourself and mind your business and I don't think there is a thing to worry about. We would all be better off if more people just minded their own business.

That's the problem people won't, mind their business. I myself no longer drink, but I don't see a problem with a guy having a couple of cold one's after a long day, it's not like the perons is getting trashed.
