allergic to trainers cigarettes

    I can certainly understand the allergy problem.

    I am allergic to cigarettes and was sent out with a chain smoker on my training.

    I threw my pillow, and sleeping bag away after I got out of the truck.

    Get another trainer if it bothers you that much then, or just open your own window every time. You know I am sure there is something he dislikes as well, have some fun with his inconsiderate ###.

    You can haul gasoline and smoke while driving, unless your company says no.

    Never heard of a DOT ban on smoking in the cab, hazmat or not.

    One has a right, by law, to a smoke free workplace, but since the driver smokes too, that ain't gonna work out.

    If there are two employees in a confined space, does that make it a public workplace subject to state smoking rules?

    I checked the FMCSA regs and there is a ban on smoking during the loading, unloading and transport of HazMat material.

    Now, I realize our instructor have meant that the school had a ban on smoking in the school trucks, which makes sense.

    I would expect many companies to ban smoking, due to the negative effects on non-smoking drivers. :biggrin_2558:

    It does not have to be a public workplace....any workplace is covered wherever there are two or more workers together.

    You could, I suppose argue that a solo worker is entitiled to work in a space that is smoke free, i.e., free from 2nd hand smoke in the environment from a prior person smoking in that space....generally a ban on smoking would mean no one ever smokes in that area....

    I'm not sure if it's all of Ontario or just around Toronto but tickets have been written for a solo driver smoking in his truck... workplace laws and an overly anal cop.

    I never did hear if there was an actual conviction on this.
