When it comes to the relationships between the feds , the states and the carriers it is important to understand minimums and maximums. If a federal rule states a minimum a state or carrier can not go below it, a maximum can't be went over. In this case there is no rule mandating a CDL driver be put in the driver pool for testing if said driver does not operate a CMV on a public road. HOWEVER there is no rule prohibiting a company from putting a CDL driver like this in the pool. Unless you can find a federal rule mandating a company not do this I think your going to have a hard time winning a lawsuit. So I think this falls under caveat emptor.

Michael White - I don't think you should've been tested, but only a lawyer can help you now. Get a GOOD ONE (spend the money), get a recommendation if possible (or check with OOIDA for a lawyer that specializes in the transport industry), and see what they say.
