Options? A server, construction laborer (maybe) gardener, landscaper, telemarketer (maybe.) Jobs like that. At least for the next few years. It's not just your driving record that's ####ed. Anytime a company asks you former company for your employment history, they will tell them terminated for failing a dot drug test. Your best bet is to complete a SAP and go from there.

I'm not going to bash you for what happened but I think it's going to be very difficult to find a company/carrier who will hire you. I do wish you luck in your search.

Get a lawyer, it doesn't matter what they think or want to do, reporting it may cause a problem for them. Unless you drive for them, EVER, then they can't report anything. This is like applying the same rule to do a drug test for a secretary or one of the managers, the issue isn't if you failed, it is whether you drove a truck for them, making you part of the pool of drivers.
In my case it was a retaliatory strike from a manager who was mad at me for reporting his stealing (he was stealing customer's property), his situation was pending because of the ongoing investigation but nevertheless, I wasn't hired as a driver for that company but shipping work and he thought it would be a good way to get back at me because he knew I had a CDL. Well his move costs the company a lot of money because they had to clean up my record, and they fired him because of it, he was later prosecuted for stealing.Michael White, not4hire and sam_j Thank this. -
If your job title is NOT a safety sensitive position; truck driver, airline pilot - or- railroad engineer; you should have not been the same drug testing pool as the DOT safety sensitive employees.
Right now there is not a DOT database for failed drug tests, it IS on it's way but it is not here yet.. Therefore they have no 'official place' to report this.
During my supervisor drug and alcohol training they went a long way to point out the difference between Safety Sensitive drug pool and regular employee testing and they went out of their way to give an example (regarding post accident testing) that you do not send someone 'just in case' there is a potential ticket that has not been issued.
The example was the driver getting in an accident hours before leaving for vacation.....
If that person tests positive AND no ticket is issued, the Medical Review Officer would be forced to invalidate the test yet the company would 'know' they have a drug dependent driver...catch 22.
All in all you need to speak to someone knowledgeable, perhaps the MRO used by the company, as possession of a CDL is NOT grounds to include a non safety sensitive person in the DOT drug test pool.not4hire, Michael White and sam_j Thank this.
