Uhn no. They wanted the ten hour driving. The break comes from the OOIDA dimwits. See their position if you read their submitted comments is the 14 hour clock was unfair because drivers were forced (apparently with cattle prods and whips listening to Spencer's tirade) to operate 11 hours straight without "so much as a needed bathroom break".
Go read through the comments submitted. A preponderance of the people there claimed no ability to take a break. I believe taking their que from Grain Valley. That form letter they had their people submit is as ignorant as the one the ATA had their companies trying to get their drivers to sign.
But congratulations to those whom requested their break. Now they have one. Really shouldn't effect anyone if truth be told.If your going 11 straight I hope they sanatize the truck properly for the next driver.
I agree the 70 and the reset should go. Never happen but it would be nice. That 1 to 6 deal has gotta be giving the LTL carriers fits. -
I got to thinking as I was upsetting every other truck on the highways of CA, OR, and WA yesterday.....I was doing the SPEED LIMIT.....ooooo they were irritated!!!
Anyway....the "wording" of the decision is typically vague, it does not have the word (or any synonym) "require"...so by eliminating the responsibility from the employer of "ensuring" the break, what is said is that the employer can not "force" the employee (driver) to take the break, only that the employer must relieve the driver of load responsibility when the break is taken.
In my opinion, the CA companies are complying (and always have complied) with this (except Haz Mat loads when the vehicle must be "in sight") by relieving drivers of load responsibility for any breaks.."and permits them the opportunity"...this is the clincher that keeps the employer within the boundaries! -
Yeah, some drivers really hate when you cover your ##### by doing the limit.

Exactly, which is why a driver is required to log it as off-duty, and must be taken by the driver within the parameters required. So there will be 30 minutes of clock time lost for the driver for the day.
