    No law defines even if you stay in texas but bills say it was originally in other state that interstate

    I think this guidance is a bit dense, but if you read it carefully, they speak of the cargo being the determining factor. This comes from part 390.3.

    Question 6: How does one distinguish between intra- and interstate commerce for the purposes of applicability of the FMCSRs?

    Guidance: Interstate commerce is determined by the essential character of the movement, manifested by the shipper’s fixed and persistent intent at the time of shipment, and is ascertained from all of the facts and circumstances surrounding the transportation. When the intent of the transportation being performed is interstate in nature, even when the route is within the boundaries of a single State, the driver and CMV are subject to the FMCSRs.

    Not sure about what Texas intrastate laws are, so not going there. The hodgepodge of State intrastate regs vary greatly, along the same lines as the various State gun laws do.

    Get stopped across State lines though with no or deficient BOL, and no inspection on truck & trailer, and let us know how that worked out for you...

    I have often wondered just how many CMVs are truly FULL intrastate? I know that a CMV is anything over 10,001 rated weight. I know this also applies to busses etc. I mean 18 wheelers that only run intrastate. Something tells me there are not that many.

    Ltls might be able to qualify if they load onto a different trailer.

    You have to have the annual federal inspection . You don't have to have a sticker for the annual federal inspection . You do need a copy of said inspection in your paperwork for the truck . State inspections are a whole other can of worms .

    Yes, also there are some states that don't have special intrastate rules, they just go by the Feds.

    Your comment triggered a memory I have of something like this happening at a state scale. My inspection sticker was not firmly on the door and the inspector told me to either tape it up or rip it off. I taped it up and went on my way. I have looked through part 396 and I can find no language that conflicts with your comment!
