Why unless it’s a paid move? Compensation has no bearing on hos duty status.

Yes it does. You cannot be paid by your company and it be considered PC. Dispatched, thus paid miles, cannot be PC.

In fact during orientation at one driving company I worked for they said it was really easy to know if something could be PC or not, if we're paying your miles, it ain't PC.

    Canadianhauler21 Thanks this.

Care to show that in the regs? If that’s the case, any driver who isn’t paid for time to do a pretrip doesn’t have to log it by way of your thinking.

PC is really simple... If the move benefits the company in any way shape or form, then it is not legal unless SPECIFICALLY noted as acceptable in FMCSA regs or guidance.

I have to agree that PC is just what it stands for ... "Personal Conveyance". Its the only time it is to be used. In the OP, that is not personal conveyance. That is for benefit of the company.

True, PC isnt paid but that's not the point.
I think the instructor explained it wrong or there was a misunderstanding.... or the trainer needs a little training himself.

Bean Jr. and User666 Thank this.

My understanding of it. If he was driving from the yard to his house. It would be PC. Maybe even from the delivery to home. But for sure not to the yard.

Bean Jr. and User666 Thank this.

I think this item from the Guidance part of CFR 395.8 says it all. Let's NOT add to it, or take away from it!

A driver may record time operating a CMV for personal conveyance (i.e., for personal use or reasons) as off-duty only when the driver is relieved from work and all responsibility for performing work by the motor carrier. The CMV may be used for personal conveyance even if it is laden, since the load is not being transported for the commercial benefit of the carrier at that time. Personal conveyance does not reduce a driver's or motor carrier's responsibility to operate a CMV safely. Motor carriers can establish personal conveyance limitations either within the scope of, or more restrictive than, this guidance, such as banning use of a CMV for personal conveyance purposes, imposing a distance limitation on personal conveyance, or prohibiting personal conveyance while the CMV is laden.

Honest question. If he's being "told" to do it. Isn't that "work?" Thus putting him on duty?

snowlauncher and Bean Jr. Thank this.

I would think not. Not in my books anyways. But again it depends on the circumstance. I drop my trailer at the company yard all the time and get TOLD to go home for reset. To me, that’s PC.
