A bit snarky there aren't you?! The original example was DIRECTLY addressed by me, as stated! Having 25+ years as a driver, and the past 8 years as an instructor/auditor of logs with my current company, I have learned not to assume what should/could have been said, but what is actually said or logged.
He put 8 hours in the sleeper, then took 2 in OFF DUTY before driving? Negates the split sleeper provision need....8+2=10! He has now restarted his 14/11/30...very simple! Which is why I asked in my previous post how he used the "4 hours". Evidently even "you" missed my point of the use of the time question.
You don't recapture anything, you have what was not used of your driving time available to drive after the 8 hour, or 2 hour break....slice it anyway you want.
If a driver is going to utilize the split sleeper provision, the driver should understand that it is best utilized in the strict performance of break and drive. Taking extra OFF DUTY time in the middle reduces the maximum usage of the split sleeper provision in extending the 14 hour maximum available time and reducing the 14 to the level of a straight 11. This statement will probably confuse many who are reading it...put it on paper and look closely...you will see what I mean.
Another split break question

I pity the drivers that have to put up with your exactness, instead of looking at what is obviously meant, and asking if that is what they meant. I may be snarky, but I would much rather have a snarky auditor than someone like you! Lol
"He put 8 hours in the sleeper, then took 2 in OFF DUTY before driving?"
Where do you get this?? I thought you said you read exactly what is written?
Where did he take Off Duty at all??
"Negates the split sleeper provision need....8+2=10! He has now restarted his 14/11/30...very simple! Which is why I asked in my previous post how he used the "4 hours". Evidently even "you" missed my point of the use of the time question."
He was very clear that he took 8 in the sleeper, then worked for 4, then took 2 in the sleeper, and the question was how many hours would he have left after the 2 in the sleeper. What are You missing here?
"You don't recapture anything, you have what was not used of your driving time available to drive after the 8 hour, or 2 hour break....slice it anyway you want."
Some still call it Recap, but of course it can only be the way you do it at your company...
"If a driver is going to utilize the split sleeper provision, the driver should understand that it is best utilized in the strict performance of break and drive. I think we all understand that, though you kind of danced around it, so some may not understand your words here.
(he means that once you start your 14 hour clock, taking off duty time still subtracts from your 14, so if you take 3 hours off duty, you take the 14 down to 11, etc.) -
"He put 8 hours in the sleeper, then took 2 in OFF DUTY before driving"
Please reread the original post. The words "Off duty" were never used.
Again, the 30 minute break was not mentioned to avoid confusion with the intent of the question. I was trying to word it it so that no one could "assume" anything about any factors that were outside the scope of the question. The 30 minute break was not part of the question. The 70 hour clock and / or the recap was also not part of the question. The question was, in this example, how many hours would be available after the second, in this example, the second break being two ( 2 ) hours. Nothing more, nothing less.
This example does not represent any actual log event that I know of. Any resemblance to any actual log is purely coincidental.
It was given as an example to provide a clear and easy numeric example to show how the split sleeper works.
This is exactly why I've had so much confusion about his issue. Every answer has been peppered with so many "what if's" and "don't forgets" that the original question was lost.otherhalftw and Ke6gwf Thank this. -
Have you two considered Xanax?
