We operate under 26,0001 lbs and have to have drug testing. I was called in twice last year.
When I had my authority back in 2006, the FMCSA told me I had to have random testing for 3 drivers all under 26,000 lbs.
Commercial motor vehicle means a motor vehicle or combination of motor vehicles used in commerce to transport passengers or property if the vehicle
(1) Has a gross combination weight rating or gross combination weight of 11,794 kilograms or more (26,001 pounds or more), whichever is greater, inclusive of a towed unit(s) with a gross vehicle weight rating or gross vehicle weight of more than 4,536 kilograms (10,000 pounds), whichever is greater; or
(2) Has a gross vehicle weight rating or gross vehicle weight of 11,794 or more kilograms (26,001 or more pounds), whichever is greater; or
(3) Is designed to transport 16 or more passengers, including the driver; or
(4) Is of any size and is used in the transportation of materials found to be hazardous for the purposes of the Hazardous Materials Transportation Act (49 U.S.C. 5103(b)) and which require the motor vehicle to be placarded under the Hazardous Materials Regulations (49 CFR part 172, subpart F).

I've been running for 4 years with 4 trucks all under 26k, no apportioned plates, no ifta and no drug testing.

I had went almost 4 years and none till the dot came in.

I have been told by three different representatives from the DOT this week that since im under 26k and no CDL I am not required to drug test.

When your safety audit comes up you can ask them, they tell you everything you need in advance, so when you get the date set call you auditor and find out.

Ya DOT told me I have to have drug testing and I'm running under 26,000. They said it has to do with your gcwr and not what your registered for. They said if the truck is 12,000 and trailer at 10,000 you don't but a trailer over 10,001 needs a CDL and drug testing.
Also I was just told today that I need irp and ifta but I'm registered at 26,000. Is that cause my truck and trailer combined gcwr is 32,000 and doesn't matter what I register at?
