The company I work for delivers everything,, from medical specimens to reels of cable to cat scan machines. Pretty much everthing that will fit in a box/straight truck.This paticular run I was driving the small straight truck, has a chevy van front end with the box on the back. Iam looking else where as they are paying me straight time even on hours past 40, I hired on as a 1099 contractor hoping to go company driver oneday, but I talked to company drivers and apparently nobody gets paid overtime hours, company employee or 1099 because is a company rule. Bull crap I say. I believe this is illegal
are bobtails subject to DOT rules?

I thought OT rules only applied if the weight of the vehicle was over a certain amount. I don't drive nothing bigger than a 24 ft box truck right now. Since you guys seem cool, ive been thinking about hiring on with Averitt or Raider Express.Any opinions good or bad? I picked these 2 companies as I have class A cdl but very limited on experience, only about a month on a job from craigslist and these 2 companies seem pretty good for newbies

Yes, you need to run as fast as you can from your current employer.
So far as I know, very few companies pay OT to interstate driver.
Some LTL companies do, and some Union companies do. I think that SAIA, does.
Mine (union) employer does, but its part of the contract.
The interstate employer I work for (non-union) does not pay OT, to anyone except office staff. -
A cmv is something out to make profit. So rules do apply more then 100 miles

You are operating in a grey area. First of all you are an employee and your employer should be witholding SS and taxes and paying 1/2 of the SS. You will be paying both halves of the SS in this arrangement. So figure about 25% of your pay to pay taxes. estimate only, now would you work for 25% less pay than you are getting paid? Next, what happens if you get hurt at work? No workman's comp, a bad situation. Now for the logbook issues. Do you ever transport hazmat? even quanitities that don't require a placcard? still need response book and logs. Argue if you desire, but will your argument hold up to the IRS and the Judge? I only hope that you get a better situation.
