This topic just won't seem to go away. Leased operators have been a part of trucking for a very long time, for some companies that is their primary business model, and do not even have company equipment except for maybe trailers. This legislation must be stopped. I urge everyone that is a lease operator to contact your states representatives and also reply to the link in the article to voice your opinion. Do you want to be considered an employee? Do you want to be be forced to take loads you normally wouldn't? Do you want to be forced to work when you feel like taking time off? because that's what it will come to if you they make you become a W-2. I really feel this should be taken seriously as this could eliminate the leased operator business model and who knows what could come next to the independent owner operator.

I also urge everyone to go to the following link and voice your opposition to such a ridiculous bill and to spread the word to any other lease operators you know and work with. They are accepting comments until Feb 24th. The link is also in the article above.

I am not for any regulation to dictate anyone as to what form of employment they can choose. For instance, if someone wants to be paid on 1099, so be it - I see nothing wrong with that.
At the same time, and it may seem incoherent to what I said earlier, I don't see the methods exercised by mega carriers e.g. Schneider to escape from the traditional form of employment (W-2, worker's comp) via their lease-purchase programs as something to be applauded for as their clearly want to escape from all kinds of liabilities that traditional employment involves and create a model in which they would not owe anything to anyone, while the anyone on their lease would be enslaved to their program and financially raped.
Independent owner operators are the same entities as mega carriers - the count of power unites and trailers is irrelevant. I don't worry there. Also, leased on owner operators are substantially different from so called lease operators who don't own any equipment.

What happens to all the lease operators at Landstar, Forward Air, Mercer, and all the others that run on the leased operator model? Forget the megas and their games, they can stop using leased operators anytime and still survive, but what happens to those companies that work with nothing but leased operators?

You kniw thise stupid guys that will run bottom of the barrel dirt cheap frieght just to keep the wheels turning??? The ones that just drive frieght rates down??? Yeah many (not all) of those are guys that got into a bad L/P deal, and just HAVE to keep moving to make money... This legislation (not AB5) would forse carriers to properly classify thier drivers as employees instead of contractors... And then there would be less guys deiving down the rates... Yeah I know it's nit going to really change the race to the bottom... But hey, worth a shot.

That is the difference. If you can take your truck to a different company when ever you want you are an true O/O.... If you are stuck with the company that you lease your truck from... That is a L/P, and that practice is highly abused by most companies that have that practice.
