    Fight the ticket. Most likey cop won't show up and it'll get thrown out. You have to tell your company. So sound like the guy that just got screwed and tell them you're fighting it because you reached down to grab your drink or whatever you make up. Don't sound guilty. And by all mean don't pay the fine. Get a lawyer if need be. IF you did actually text then they may warrent your records from you phone company but that would prob be at a judge disgression. But for $168 I doubt he take it that far. Good luck.

    Since it wasn't on an inspection sheet Was any information regarding the company you are leased to on the ticket? If not, just pay it and never speak of it again. If the company info is on the ticket get a lawyer and fight it. If no company info is listed it will be like getting a ticket in your personal vehicle.

    The way the ticket is worded is specific to a commercial vehicle

    I didn't notice where he said commercial vehicle. Maybe I missed it though.

    I still wouldn't say anything though. Especially if they are going to fire you anyway. You got nothing to loose by not telling them. No telling how long till they pull your MVR again. Normally the insurance company does once a year.

    It says federal reg. Not State, guessing thats because it a commercial motor vehicle?

    Straying slightly off topic does anyone know even if they do pull text records from the phone company how do they look at it now with the ability to send hands free texts?

    Who would be pulling text records? In the absence of a court order, or exigent circumstances, the phone owner would have to consent. That's why you always have password access and never voluntarily give your phone to anyone.
