    In the event of a fatality a judge may grant a prosecutor a warrent for your phone records. Happend to my cousin when a drunk driver hit him on the passenger side of his truck and killed one of the riders in the car. Dude ran the stop sign and hit him. My cousin was cleared but they still got a hold of his phone records for both of his phones

    What?????? You actually have a pretty good idea when they are going to pull it again. see 391.25 and 391.27

    Most carriers pull them just before your anniversary...unless they have a reason to pull them intermittently.

    every company i've ever been with. pulls mvrs in january, no matter the start date.

    it's a federally coded citation. because it was DOT or FMCSA that implemented the law. the states just enforce it.

    if you didn't get a inspection. then you've got nothing to worry about in csa.

    if it's a citation, hire lawyer. or call roadlaw for consultation. it's free. they can tell you what your chances of fighting are.

    Code Part 392 falls under the "Unsafe Driving Basic".
    392.2-SLLT :::: State/Local Laws - Operating a commercial motor vehicle while texting :::: Severity Weight, 10

    It WILL show up on your CSA regardless of what branch of law enforcement wrote the ticket.

    However,
    "Carriers do not inherit any of a new hire’s past violations. Only violations that a driver receives while
    driving under a carrier’s authority impact a carrier’s safety record."

    Therefore, if you get fired, a different company might hire you. The above info is straight from the CSA web site

    Wow, I have a similar situation I just got terminated from C.R England because they assumed I was texting and driving. I don't have anything showing on my DAC report at all, he'll I didn't even get a ticket or anything from a state trooper or DOT for it. Pretty much they made an assumption that I was texting and driving they don't have any cameras showing I was texting while driving or anything on paper smh. I got terminated on 12/27/2017 I can't get a job anywhere not even Swift but today I'm finding out that they haven't put it on my DAC Report but they did put on Driver Facts that wack ### 9month contract stating that I can't use my cdl for any other company until I reach my 9 months. Killer part is my 9months would have been up next month in February. Can anyone help me and give me insight on why it's not on my DAC or can I call back the job I applied to over again and just don't say anything about getting termed since it doesn't show on my DAC.

    Sounds like you need to lawyer up. Taking what you claim at face value, this is just one more of many stories out there how mega carriers ruin lives.

    Well, CR England cannot control your CDL. Only the state you obtained the CDL can do that.
    Having said that, there maybe something in your employment contract, a "No Competition clause" that says you cannot drive for another company until your 9 month probation period is over. But that would require them to take you to court and spend a large amount of money over a trivial situation. More of a scare tactic than an actual threat.
    As to what they are saying to prospective employers when you apply and they contact CR England for employment verification is anyones guess. Reports to DAC from an employer can take some time before they show up.

    If you did not text and yet they fired you for texting based on some made up crap, I would not have any qualms about not saying anything.
