This is correct, there is NO MANDATE by the Feds to have a sleep apnea test. Many clinics try to bamboozle a driver into thinking it is needed. This was reported in an issue of LandLine Magazine, from the OOIDA, several months ago.

It seems to be at the doctors discretion as to who needs to take the test. They look at your BMI or FBI (Fat B@st@rd Index), if you're a husky guy with a gut and fat neck you are a prime candidate. My Doc says I'm borderline because for my height I am overweight but I don't carry it around my waist or neck so I have never taken the test.

I am a union driver.
It isn't necessairly the union itself calling the shots, but the employees. The way most (if not all) unions work is that a Collective Bargaining Aggreement (CBA) is established and agreed upon between the employees and management. The union represents the employees and enforces the CBA.
Many of the horror stories you hear about, you don't hear from union shops for this reason. We don't tolerate corporate BS.The Patriot Thanks this. -
Exactly right...Which in turn means,Drivers (collectively) are NOT going to let some half-### ATA-FMCSA ruling about health/medical play ANY (I repeat ANY) part in the Well-being of said drivers employment....
To break it down easy for those of you who don't understand.................a heavy-set or Physically challenged driver will NOT be challenged for discrimination due to his/her size or capabilities... They Will ALWAYS have their Jobs ..If a Driver (for some odd reason) simply cant drive anymore, The Union and company shall find other tasks within said employerFlybynight041 Thanks this. -

I can agree with you in part. I once had a union job, but the union sucked. I was ever so happy to leave that place. Seemed like the only thing the union was good for, was our seniority list for vacation times, or other bumping of the lower guys for other reasons. If I had my way, and started all over again, I'd go union for sure, but most certainly a much better one then the one I was once with.The Patriot Thanks this.
