    That 8hr rule is a bunch of hogwash. You can take a lot off of a machine in 8hrs.

    Of course if you’re a 1 man show with no lifting equipment, you could take years and still not get the blade off a D8.

    Right...so that driver should have never received a citation for his load.

    Exactly...the law says...

    "The applicant for nondivisible load permit has the burden of proof as to the number of workhours required to dismantle the load."

    So in my case if I was in court to prove my point. I would tell the Judge that I paid one mechanic to disassemble the device from the machine and I have payroll records and shop supply records to prove it. and it took a 10 hour work shift.

    It does say with "appropriate equipment" which would mean whatever would be needed I guess. In Ohio (which is what I'm most familiar with) the 8 hour rule is just one of the criteria, if tearing it down would violate the others you don't have too.

    No you would even have to do that, just demonstrate that doing so would "
    Compromise the intended use of the vehicle, i.e., make it unable to perform the function for which it was intended" and the burden has been met. The "8 hour rule" isn't an "island" it's a potential remedy.

    Yeah 9 times out of 10 it probably wouldn't even come to getting a ticket if you got a smart Officer who can recognize a smart Driver/Owner/Carrier.

    Yep, I still have a hard time with some customers explaining to them that I can't haul their excavator with the bucket on and a hoe pack in the bed of the dump truck. I could only imagine how that conversation would go if I had to leave the bucket!

    yeah that's hosed...I've caught a few youtube vid's watching these guys down in South America hauling their excavators that way...funny stuff!
