At fault is a legal determination that can only be made by a Judge. Of course when we are involved in an accident we NEVER admit being at fault. If there is anything that you can think of would have prevented the accident then you know that this accident was preventable. Your safety committee will find as such. You had a preventable accident while backing. Most companies will fire you for that.
I have been fired three times for accidents. The first time was when I was pushed off the road in a snow storm. The highway patrol gave the other trucker a ticket. I could have prevented the accident by slowing down and not being in the man's blind spot. So, I was correctly fired for having a preventable accident. That was Keystone Automotive. I was a great job and I hate the fact that I lost it. ACT fired me because I hit my head under a trailer and then, not knowing I had suffered a concussion, tried to drive. I struck a pole in the the center of my trailer, knocking a hole in that trailer. I was again, correctly fired. I would argue that being in a confused state should have bought me some slack but driving in a confused state was very dangerous and could have killed me or someone much more important to the world.
My last and I mean my LAST time I was fired for an "accident" was by Transport America. A good company but this one was wrong. I was riding with a trainer in his vehicle. He wanted to scale the load and had me drive back and forth over the scale at his direction. He put his self on the passenger side of the truck. I pulled back and forth 5 or 6 times at his direction. On my final pull forward the steps up to the truck rubbed against the curb on the scales. It made a 2 inch scratch on the vinyl below the bottom step. My trainer when nuts. He called safety and reported me, telling them that I had, "###### up his truck". The scratch buffed out with compound. Safety called me and I told them that I would not even have reported the incident. They fire me because of that. I was wrong to have told them I would not of reported it but I would not have.
The scratch shows up on my DAC as "hitting a stationary object." It has affected me from getting a dream job.
My point is, I have found other jobs. One, two, or in my case three things on your record will not keep you from get A job. But it may keep you from getting THE job you want.
Learn from your mistake, which starts with admitting your mistake. You will be a better driver with each lesson learned. I bet you never again allow a car to slip in behind you.
Backing incident. Utterly sick with myself.

The idiot that's actually in the wrong for sneaking up in to your backing space. Is NEVER held accountable.
My last job as a mechanic, where i worked for 6 years. Had an alignment rack on the last bay. On the outside of the building were NO PARKING signs on the wall from left to right. BUT, behind the alignment rack, on the outside wall. Was an air hose. With no tire fittings. You'd open the door, jump in the car, look in the mirror on the machine. NOBODY THERE. But by the time you back up to doorway. There's a car. Trying to get air from a hose with no connection. HAPPENED about 50% of the time. I"m always cautious because of that scenario. But one time i actually bumped a car. The car called the cops, and he got the ticket for being IMPROPERLY PARKED. If it wasn't for the NO PARKING SIGNS. i would have gotten the ticket for improper backing.Criminey Jade Thanks this. -
