I have experienced the same issue he had. I didn't get suspended/fired. But I have had texts that didn't get sent for more than an hour after hitting the send button.

I wonder if a driver facing cam would have corroborated his story.

On the one hand I feel bad for the guy. On the other, stopping on the shoulder to send a text message... -

I love how these company’s will make such a big show about no texting or phone calls while driving, and then THEY call you, or send you messages while your driving. With all the computers and GPS they require you to have on your truck, they know when your moving, parked, idling, or shut down. My company got so bad about calling me halfway thru a 10 hr. Break, that first I warned them, then I began restarting my break after they woke me up. The DOT Regis say 8 UNINTERRUPTED hours of sleep. Company’s need to be taught, all the rules apply, not just the one that are Convenient for them.addrenjunky, drvrtech77 and DenBob Thank this.

Whether it is true or not in this case, who knows. But it's certainly plausible. Happens all the time.
I suspect this is a guy they wanted to get rid of, and used this as justification. They'd overlook it, or never look into it at all, if he was a valued employee. -
I have always kept my ringer off during break.
Not everyone has that option , I know.....family reasons etc.
And not having a headset means I never had to take a call I didn't want when driving either. -
The second time I did it, seemed to do the trick. When they squawked about it, I asked them if they ever bothered to review our electronic logs. They said of course we do, I then asked if they bothered to check our status prior to calling to see if we were sleeping, or possibly driving. It got real quiet on the other end. Since then, I’ll sometimes wake up and find a text asking me to call when I’m up, but no more speed dialing until I answer.Cattleman84 and speedyk Thank this.

The real reason is Nestle didn't want a guy named Kraft working for them, they thought he was a spy.
