    How sooooo? My past record. I know of drivers that do crack and have felonies that drive truck. I have or want no part of that lifestyle but yet I seem to be the on that level by the tone that you refer to me. Question for Show Time

    Per NY state law:

    1. The driver may not have any alcoholic beverage (including so called "non-alcoholic" beer) anywhere on the vehicle or combination. There are exceptions if the beverages are part of the legitimate manifested cargo, and for bus and limousine passengers.

    How could you legally drink a few beers now and then when you're away from home for a month aT the time.
    you can't drink at the stores' premisses, neither on the street, do you go hide behind a dumpster like you're smoking weed or taking a dump, or do you hide under your trailer and pop a can when doing your 34?
    I'm curious as to how some would "suggest" handling a few drinks "on your time off"

    Had to be more than just possessing a 6 pack to get him a DUI. Possession and consumption are 2 different things and neither mix with a CMV unless it's manifested accordingly and in the box and not in you or the cab.

    Some states are strict with their "open container" laws...in that if that 6-pack is half of the 12-pack that it was sold as, it is classified as an "open container". Even in a personal vehicle, it has to not only be unopened, but the original packaging also has to be unbroken.

    That's for pretty much any vehicle on the road, except the living quarters in RV's and the passenger areas of commercial busses/limousines. A commercial T/T does not meet any of those exceptions. For a commercial T/T, the FMCSA regs ALSO apply, which prohibit ANY amount of alcohol, without regards to whether the container is open or sealed in its original packaging. If the seal has been broken, though, violating an open container law in some states isn't any different than driving under the influence...fines, suspensions, etc.

    Why some insist on taking that chance is beyond my comprehension...ESPECIALLY when their livelihood is attached to their driver's license. If having that drink is worth risking your career, perhaps you should just get out of this line of work now and save your employers the hassle and the rest of us who take our jobs seriously the bad publicity when you eventually get busted.
