First this is my opinion, and Mine only, if you do not like it sorry about your bad luck.

But First off When I am stuck for 3 days in Ontario, Ca and I decided to get a 12 pack, some steaks, and grill out. I will climb in the bunk from the chicken door, my Business. I will not drink anything 24 hours prior to departure, my choice. I will not work for some chicken S&^*& outfit that has paid liars and narcs. I have on many occasions sat at the back of my trailer, with a Grill and cold beer with 10-15 other drivers bothering no one, enjoying some downtime. I met my Ex Wife ( another driver) in Ontario, Ca over a Cold beer and a Steak, not to mention she was one Fine ### woman, (ended up being my ONLY co Driver) . A responsible Adult will know how to handle his business. I would not advise climbing in the truck from the Drivers Side, nor putting the keys in the Ignition. Being in the Sleeper is not against the law, having an Open Container while you are moving is. Some of the old Hands on here know where the REBEL Truck Stop is and I will be ###### if there has not been a few beers knocked down in there before some tired ### driver climbed in the Bunk. I think that is why so many of the "old" School drivers have adopted that mentality "You drive Yours I will Drive Mine" it is just a shame some dumb kid will goto the Bar get bombed and wake up 4 hours later and drive off, get caught and ruin his short lived career.
If you choose to have a drink or beer, be smart about it, common sense, and if you are in a CV .04 ain't much.

If you had it in the rig and got in an accident, then police found it while doing their investigation you would have a lot of explaining. I like the idea of putting it in a box and mail it.

Alcohol of any kind in your sleeper is illegal and you are skating on thin ice to do what you just described in CA.especially.If a truckstop operator or goody two shoes drops a dime on you and they find beer in your truck you will wish you took a cab to a steakhouse.

All I know is what is on the net. In Indiana there's some that say you have to be driving a CMV and some say you only have to have it. I will say Indiana is the first state I've seen that has it both ways. Also the FMCSR's do not apply when you're driving your own POV.

Look, I'm an advocate agains't drunk driving. I drove a gasoline tanker in Las Vegas where there's plenty of DUI's going on. I wouldn't hesitate for a second to call the police if I saw a druck driver weaving down the road. But I'm also an advocate on passing correct information on to someone that doesn't know so I look for a link or reference giving rules regulations, and laws the validly they need. You may be 100% right but for me I need more than a court case. After all they could be wrong. I bet from now on anyone driving in Indiana will throw their CDL out the window and take driving without a license before a .04.

I didn't realize this, seems like high school or something. If your on your break or getting a restart you can't have a few beers? Thats stupid, we are professional drivers but can't drink in our assigned trucks on our time off? I don't agree with it.

The rule is in that little green book.I threw mine away when I retired.I know of plenty of drivers who found the hard way over the years.

OP is now so confused he doesn't know WTF to do.

Federal regulations only pertain in certain circumstances.

Then you have local, state, and other rules to go by.

I've seen drivers go to jail for drinking at a truckstop..........

Parked on private property, when empty and off duty, if the property owners don't care, and no local laws are being broken....you're fine.

So many factors are involved......you're taking a big risk in my opinion.

If you don't drink, this is a rather strange question !!!!!

    But hey, Good Luck !!!!

I knew a couple of Celadon drivers who put three cans of hot beer in the junk box of a cabover International. They didn't want to leave it in the motel room they were in.They got inspected at the Brownsville,TN.scale and opened that box to show the DOT officer their fire extingsher and triangles. The DOT saw the beer and arrested the driver he had a $1200.00 bond. This happened in 1986 I don't think the DOT has loosened the rules in the meantime since then.
