    [h=2]Crossing the Canadian border with a DWI, DUI or Other Drunk Driving Offense[/h]An offense of driving under the influence will not cause any problems for Canadians entering the United States.
    However……….
    the biggest surprise for most Americans is that they may be turned away at the Canadian border if they have any type of alcohol related offense.

    • It does not matter if you are arriving as a passenger in another person’s car.
    • It does not matter if you have no intention of driving in Canada at all. For example, 4 to 5 passengers a week who take the ferry to Victoria Canada for a one-day walking sightseeing trip are turned back for DUI / DWI offenses even though they do not have a car with them.
    • It does not matter if your offense was classified as a misdemeanor or a felony.
    • There are no exceptions for fans, guests, officials, or anyone else entering Canada for special events. Former U.S. President G.W. Bush had to get a special waiver to enter Canada because of his 1976 drunken-driving offense in Maine.

    [h=1]DUI Convictions Prevent Crossing the Border into Canada[/h][​IMG]The Canadian Government will prevent certain non-Canadian citizens from entering Canada under their restrictive immigration laws. These individuals are members of an Inadmissible Classes. The Inadmissible status prohibits an individual from entering Canada and remaining within their borders. People often confuse this concept because they believe they can enter Canada as long as they are not driving their vehicle. That is incorrect. Having Inadmissible status means you cannot enter, visit or travel to Canada.
    Some criminal convictions will prevent a non-Canadian citizen from crossing the border into Canada. Minor offenses like shoplifting, theft, possession of illegal substances, and unauthorized possession of a firearm will prevent entry. Felony criminal convictions will also deny entry into Canada.
    [h=2]Canada and a DUI Conviction[/h]Canada regards DUI / DWI as an extremely serious offense. A conviction for Driving Under the Influence (DUI or DWI) will qualify you as a member of the Inadmissible Class. Those non-Canadian citizens with such convictions will not be allowed to cross the border into Canada freely.
    The Inadmissible status can be removed, after a period of many years, by applying for a Minister's Approval of Rehabilitation. Although, you can visit Canada before the Inadmissible status is removed. This requires you apply for a Temporary Resident Permit. The Temporary Resident Permit allows you to visit Canada for a single purpose or for a limited period. This process requires completion of forms and paying fees. It is strongly recommended you retain the services of an experienced Immigration attorney to handle this process on your behalf. An Immigration lawyer will know how to expedite the request and will not make mistakes causing delay.

    The Canadian Consulate General in Los Angeles, California
    The Canadian Consulate General in Seattle, Washington

    [/h]The U.S. does not deny entry to persons with a "Driving Under the Influence" (DUI) conviction, although if there are multiple convictions for this and or other misdemeanors, you could be denied entry.
    Generally, any convictions for drug possession can result in denial of entry. If the conviction was long ago, you might contact the U.S. Embassy, Office of Consular Affairs in your country to obtain a waiver. Other misdemeanors may result in denial if they were recent.
    A crime of moral turpitude (CIMT) may be grounds to deny entry to the U.S. For a list of crimes; please click here.

    Prairie Boy - one thing I've learned, and why I wouldn't engage you or anyone else on the fine points of border law, is that they have many laws for everything - and they overlap. If you think you understand it, and can site a law, well you couldn't be more wrong. If you ask one border guard a question one day he will answer one way. The next guy will site a totally different statute and answer another way. I have had difficulty with passage as well as shipped weekly goods both directions for years.

    If they want to cause you problems, I guarantee there is a law on the books they can apply to you to make your life difficult. Then you see the guy next to you start to argue - well, he's done for.

    I've dealt with US Customs laws going back to 1980. I looked after as many as 316 trucks crossing the border almost weekly.

    The best thing you can say to any US Customs Officer when asked a question is "The Truth".

    I had a guy turned back one time, he was 34 years old and omitted to say that he had been convicted of stealing a carton of cigarettes when he was 19 years old.

    I got him a lawyer that was able to get him a pardon.

    Also remember, that every Customs Officer has a Boss. I went that route on a couple of occasions to my benefit.

    I'm glad that worked for you.

    I agree about the lawyer. That is the route I resorted to - anytime I was doing anything different I'd stroke the check to the attorney and show up loaded with all kinds of paperwork. I never had a problem then, I guess the border guys know the lawyers know the laws better than they do. I would rather just be reasonable, but they just won't be reasonable back.

    Good thing about being Canadian is knowing we are not self centred pricks. In Canadian schools we learn a little history from many countries, in America they only seem to learn about themselves and think they are the centre of the universe.

    A simple proof, I may not be 100% familiar with all of the USA! but I have heard of all the states. While in Mexico and Dominican I ask many Americans if they have heard of saskatchewan and 90% of them look confused. I told one guy I was from Saskatoon, Saskatchewan and he asked me if that was a Indian tribe.

    Not sure about what growing up I need to do but when Americans constantly ask Canadians if they know Bob from Toronto not even knowing it's across the country and there's more than 5 people here and they believe we live in igloos and all speak French but then expect Canada and the common wealth to protect their butts in war it kind of makes me wonder. Also not sure about what bread they butter, last I checked it is a pretty mutual balance on import\exports.

    I fully expect every American on this forum will take offence to my post and rightfully so as alot of American truckers are familiar with Canada... These are not who I speak of.
