Beware crooked Mercer!

    It sounds as though you are saying it’s okay if Mercer breaks our contract and pays less than 75% as long as they successfully tricked me into accepting the load because I was dumb enough to believe the rate quoted was 75%. Therefore I should just get over it and let Mercer get away with it.

    I said no such thing. I asked a very simple question that you refused to answer twice now. I indicated no judgement on either parties part. I do begin to get suspicious of people's motives when they deflect the question then make allegations against the person asking it.

    So for the third time, you were offered a load at a specific rate. Were you paid that amount or not?

    Yes, for every single load I hauled at Mercer. And I still sued them for breach of contract.

    And yet you didn't. At least not the case number you gave. You are a defendant in that case.... The most you have is a counter claim for breach of contract.
    Too bad the court doesn't make public documents that should be public.
    Unless you have a different court case where you actually did sue them.....

    If you read my previous post I said they filed suit against me to force recovery of my trailer. I countersued Mercer in the same case for breach of contract. I am defendant and Counterplaintiff in the same case. If you sue someone in a separate case that is not a counterclaim. That’s just a regular claim. A counterclaim is a claim filed by a defendant against a plaintiff in the same case. So yes I did actually sue them. It’s for real and not just pretend. This is why everyone should take a civics class.

    Looks like Mercer is in the hot seat in this case. When a court subpoenas files you have to follow those instructions TO THE LETTER-like it or not! Nobody wants to run afoul of a judge and get a possible contempt of court charge,which is what is happening here(most courts-civil and criminal alike believe in FULL DISCLOSURE,unless the judge issues a gag order or orders such files sealed). As far as the judge is concerned Mercer is withholding evidence that shows the OP was telling the truth about his counterclaim(and Mercer’s false claim).

    Not necessarily. Some judges like to legislate from the bench. They forget their job is to interpret law, not write it.
