:angel9:turns out the owner bobby.wont return any call's made by the "dept of labor".The lady called me this morning,so I gave her bobby's personal cell number.
I also learned that BIG DADDY EXPRESS was suppose to give you a payroll statement at the end of the year;here's where it gets complicated.
    If you are a subcontractor,driving an owners truck,an he's leased to a company.then your suppose to receive a 1099.
But driving an owners truck, for the owners trucking company;means that your a company driver, bobby should have taken out taxes. He did'nt do it for me.an im guessing he didnt take out taxes on you either.
Thats called tax evasion. Its against the law.
:yes2557:I think, bobby isnt reporting all his income. Two trucks that I drove were #065.He might have more trucks than he's reporting. In 2008 he reported 15, in 2009 only 9 trucks.
My next step is to contact the IRS in IL,its going to get ugly. Bobby is gonna really hate me.
You need to contact the IRS yourself,CYA an tell them about how you were payed.
If you dont do anything,an bobby reports that he payed you as a subcontractor,an you dont report it.Believe me in a few years the IRS will notify you Of the late mistake,an you'll pay more, with late fines an interest.YOU ALREADY KNOW THIS GUY CANT BE TRUSTED.
I think bobby might end up in prison.

It is important you see this through and fight for what is right because it is your right (at least as of today) and cements your future.

A large number of small companies pay with that 1099 B.S. I guess it saves them money since they don't have to pay into unemployment benefits and workers comp as they would if they paid you like the employee you are.

I even heard of one company (fairly large one with about 50 trucks) that made the drivers all get tax ID numbers to get away with paying them with 1099s.:biggrin_25512:

Wow!thats crazy. After talking with a insurance investgator. He told me that Ill has a state law that every company worker, has to have workmans comp coverage.Thats another law Bobby broke. This is suppose to be paid by the employer.
And Im going to work for an owner op,thats leased to a very strict, high security company. An even working for him,the company states (in ohio) that I also need workmans comp coverage. This company will deduct that from my pay settlement.$43.00 a week.
