    This man sent me a text stating that he had driven his 14 logged out, then preceded to log back in as his co driver and drove their miles. I have it in black in white. So now that he has been caught at it, this is what they had to say, I didn't really do it,I LIED,YEAH RIGHT!!!! DOT gave his company a call, but yet still nothing has been done,THEY SHOULD HAVE BEEN FIRED, NO QUESTIONS ASKED,!!!

    This does not make sense.

    Turn in your materials to the Commercial Motor Vehicle Enforcement Dept of where that violation happened or the terminal location state. Once they understand there is a serious and outrageous violation they will take action.

    If this driver keeps doing it he's potentially going to get someone killed. Possibly himself, codriver or someone else or even a family or worse. And then once it's discovered that there is this complete and utter violating ELD etc that company or whoever owns that truck and stamps payroll for that violating driver will probably be wiped out at sale to pay the millions upons millions of civil judgement against them.

    This is all I am writing here. Generally if you know of a crime such as this violation (A small one, but a violation nevertheless at the Federal Level because it's Federally regulated by FMCSA, DOT etc... you could potentially be charged as a accessory knowing these things but doing nothing to focus the correct enforcement when everything apparently happened or is happening.

    It would not be the first time a company showed a utter disregard of flagrant violating of HOS.

    I was informed that my only option was to get an attorney, because what happened was a civil matter. While Big M Transportation's driver S sits back with a big smile on his face and having a good laugh over what he has done, thinking he gotten away with this. But this isn't the first time Big M Transportation has covered this driver's behind by LYING for and like I said covering for him and making his problems go away. The company should be held liable for their part in what has happened as well. THIS IS THE MOST CROOKED TRUCKING COMPANY I HAVE EVER ENCOUNTERED!!! And they just seem to keep getting away with their crookedness.

    Do not be surprised if a moderator amends your posts, you cannot put phone numbers or name names publicly in a forum, that creates problems for the website and it's staff legally etc and only god knows what else.

    I understand your frusteration, but keep in mind that the driver committing the violation will eventually have some sort of balance applied against him or her for doing it. HOS is there to protect not only the People on the road but also to keep the industry regulated so we don't go wild running without regulation.

    The company whose drivers violate must take certain actions. If they do not (As some companies have in the past) or worse aid and abet drivers to violate HOS they themselves will be held at risk of being taken completely out of business by the FMCSA and State they are in. We have had companies and sometimes Owners or Managers who were in a position to allow violating drivers to run themselves prosecuted and removed from Society for a while in addition to fines.

    Try to separate your frustration and emotions and look at the problem and do what you need to do to get it stopped. Or you might be moderated and or other actions to prevent problems. Im trying to assist you in understanding your limits about any given topic.

    It is never good when people know of a ongoing violating and it erodes the system and corrupts unnecessarily. There are violators of the HOS either by accident or deliberately. The deliberate violators generally will be taken care of because the company has to do it up to and including firing. IF the DOT or Police post accident catches this driver intentionally violating HOS then that will be a whole barrel of issues (And rightly so) against the lawbreaker.
