You are correct to a certain level....

Because he directly brought in and confronted him from the original instance, the two likely would have still been connected by a prosecutor.

Similar if two guys get into a bar fight. One leaves and simply goes out and stews in his car. Second guy comes out and is shot by the first after 3 hours have gone by. Because the two were seen having a fight 3 hours earlier, it's likely to still be viewed as connected. Had it been the next day or a week later, not as likely.

Likewise, 5th degree assault only has to cause fear of bodily harm to a person. All one has to do is reasonably articulate fear.

And yes, this IS part of the MN permit to carry firearm classes I teach. It sucks, but there are major legal issues that come into play anytime you confront someone. Especially when one participant is emotional. I don't care WHO is having the bad day. Even telling the jack wagon to f-off and seeing you put your hand up to guard yourself can be seen by a distant witness as a form of assault.

If you think I am singling you out, I am not. I am hoping you can see that this could have turned REALLY bad for yourself (OP). It's a lesson all of us can learn from. Today's society sucks in that aspect. You are no longer allowed to even protect yourself anymore without risk of being criminalized.

Were you right at the first incident? Yop, totally. The second took it into a major grey area IMO, with seriously leaning towards too far.

Personally, I saw nothing wrong with Pete asking the guy why he was so pissed. I'd be concerned to, especially if it was I who possibly pissed him off and somehow didn't realize I had done something to do so

Unfortunately, it's beginning to mean a man has to turn and walk away....

Karma will bite him in the butt another day though.

Sorry, im not a hothead, but I would have put him oUpn his butt and then called the cops. I was in the spec. forces I can handle myself. But I will not be pushed around, ill defend myself within legal limits and have the guy arrested. Happened to me once at the Lombardi service plaza in N.J. Guy asked me for money, I said no he pushed me for no reason and raised his fist to hit me, I took him to the ground and hit him twice to subdue him until someone noticed and came to help. Guy got arrested and 6mos in jail.

This situation exemplifies why I'm not much of a people person. I get not getting into it out of fear of breaking company policy and losing your job. I also get when the preacher man says in order to get right with Jesus, you have to turn the other cheek and walk away. This guy had a bad day. I'm real sorry and hope it gets better, with sugar on top. When you have emotional problems, call Dr Phil. Whatever you do better not involve touching me. I need about 2 square feet of area in this great big old world to conduct my business, so you can have the rest. Don't put your hands on me, or I will put mine back on you. If you get the best of me, then I'm going to the truck and getting something long and blunt to swing at your head. I don't care about your problems. I don't care if the kids are sick, wife ran off, house burned down, whatever. Don't put your hands on me or I'm going to teach you a lesson one way or another. To look at this scenario in a different way, pretend like you got arrested and they take you to the county jail. They close the door behind you, and somebody else does the same thing. He's having a hard day because he's in jail for crimeny's sake. What would you do? Turn the other cheek and walk away? I've watched enough television to know that if you did that, you would end up married to whomever had the most cigarettes and you would be giving your new husband a pedicure before lights out.I'm no tougher than the next. I'm not a billy bad-butt either. I'm 6-1 and weigh 170 wet. But what I am is crazy when it comes to people putting their hands on me. That dude is going to learn a lesson one day

Hmm, I know several happy drivers, me included and I'd say the majority at my company are happy. Good pay can be attained but not by all, only those with the best backgrounds and records. Not happy slinging freight? Move on to specialized trucking ... heavy haul, Hazmat, tank and other specialized trucking.

I agree with Landstar8891. Get with the winners in trucking. Walmart pays their drivers an AVERAGE of 72K. Perkins heavy haul pays an average of $90K. With bonuses in my part of the country, Sunoco drivers regularly hit 80K. Ask the drivers working for these companies if they're happy.

To those who say trucking is in the toilet, getting worse, etc., they're staring at the bottom of the deck. Wanna make the bucks? Think outside the box. General freight ain't where it's at and it's as you say, many of the companies don't pay what the driver is worth. My question is ... why work for them? However, the flip side of that argument is ... there are companies that do pay good. Very good.

I would of turned around and as he walked away pulled his sweat pants down as I held my breathe. Then I'd step on the backs of his flip flops and pushed him down. As he scrambled to pull his sweat pants back up I would of gave him a big ol' hay maker! :)
