Others that answered had nothing to do with what I asked or it was misinformation. That alone is the reason for my attitude. An apology was given by self when I had my terminology wrong. That's my personality you don't have to like it and didn't ask for your opinion of it. There are some people who are okay with wrong answers and misinformation. I am just not the guy.     It's my understanding that in order to use a list of Process Agents that you would need to register that list with the FHWA and obtain a FHWA ID Number. Otherwise you would be using a list that another company has compiled along that is registered to that FHWA ID.

    In theory, yes. Contact 50 individuals in 50 states, ask permission, submit list to FHWA, obtain an ID number, and roll on.

    Thank you marlin46. I am about to follow up on your response. I just briefly looked on the fhwa and need time to navigate. In general a process agent information is not private it's public information with regard to the address and phone number. The value of a process agent isn't in having or choosing them as your process agent. The value or cost comes when there services are used. No different than having 5 pizza places to chose from with there address and phone number and giving that list to a friend to order a pizza. The value or cost of the pizza comes when you order there services. You are not falsifying information by having that list, that is what the public information is for so you can use there services at a later date. There is no qualification from a process agent for you to use there services therefore no permission should be needed if you choose them. Again only my guess because I have yet to find evidence otherwise. I can understand if the fhwa wants you to register the list of process agents for no other reason than to see if they are qualified to be a process agent. Again marlin46 thank you I will begin looking into what to wrote.

    I should ask is a process agent address and phone number public or private information? If I give a friend a phone number to auto insurance company and the friend calls the company the auto insurance company isn't going to tell my friend who gave you permission to call up. The auto insurance company does have to have a licence and therefor registered with someone. Maybe that's a bad example but seems on par

    Sorry this is wrong there is no technically you can about it.

    First off this is a legal representation for your authority, not a "put it on the app because it fills the space.

    Second you have to have the agents permission to use them. That means you have to contact them, have an agreement in place and then get a confirmation that they are your agent for that state.

    Third I will repeat this, if you put down an agent and the fmcsa goes to confirm it with no record of an application or contract in place they can nullify your application.

    This is not a hard thing to do, there are agents who have representation for the entire country, as it is for other industries. It just takes a little time to look into it but the better alternative is the OOIDA.

    Not sure the point of combining these two statements or what you are suggesting. That statement explains nothing

    according to the fmsca website-Either the applicant or process agent, on behalf of the applicant, can file Form BOC-3. So IMHO the use of the word technically was used properly here when the message be sent out in the post is no, an applicant can not fill out a boc-3

    366.3 eligible person .All persons (as defined at 49 U.S.C. 13102(16)) designated must reside or maintain an office in the State for which they are designated. If a State official is designated, evidence of his willingness to accept service of process must be furnished
    --there is no mention where you need permission to designate a process agent. You do need permission to use a state official. Process agents are not determined they are choosen. That's why the have their address and phone available so they can be choosen to provide you service to my understanding. That's all a boc-3 for is, a list of names, address, and phone numbers. No services have been performed by a process agent by filling out a boc-3 form. Their services come into play when they process legal papers or deal with arbitration matters at which time they can be compensated.
    Fmcsa is not confirming permission from a process agent they are confirming that they are qualified and that their information is correct not wether the process agent gave the green light to put their a dress and number down on a filing. That's why it would be important for an applicant to keep track of a process agent info in case the closed there door. I could be wrong it's not about the process agents approval it's about the information on the the process agent that is important and being kept up to date on a boc-3 form. I say form and not contract as you stated ridgeline.

    Also I mentioned boc-3 forms having phone numbers of the process agents. The boc-3 only requires the name and address to be listed

    Oh for Christs sake, you already wasted more than $30 of your time on this issue. Just pay the #### $30 and get it over with. Some people just like beating their head against the wall. If the $30 is an issue, find another job. Besides, how are you going to know if your agent moves to another state. Let the company worry about that.
