Hello!
I was going through setting up my own authority, doing all the paperwork filing myself. upon reading some of the required papers on fmcsa's website they said to do a:
BOC-3 (Designate Process Agent)
what's a boc-3? what's a process agent? is it someone that does legal docs on my behalf? why can't I do this myself?

As a business person, you have to be available to be sued, therefore, you must designate someone to receive any paperwork from a lawsuit that may be filed against you. The reasoning being some business owners are shady and try to hide from lawsuits.

In the first few days after I applied for the authority, I got a lot of calls from people wanting to file the BOC-3 for me. I would say maybe 8 calls within the first 2 days.
There are a lot of scammers out there where process agents are concerned - a couple of them represented themselves as being with the DOT that it was an absolute must that I use them immediately or there would be a big delay in getting my authority. The scammers were always at the high end like about $75
I got some mail as well. One was from Processagents.com - they claim they are number 1 and have representation in all 50 states. They charge $50.
I'm not really sure what the purpose of them being in 50 states except maybe it makes it easier for someone sue you since they can serve the agent in their state I guess. So in a way that sounds like a bad thing.
A nice guy called me in the early days and was asking $30 - sounds like a husband and wife combination working out of his home.
Is there any reason I should go with the big guys or just give my business to the cheapest. I think this is mainly about uploading a form to complete my authority unless I am wrong on that.slow.rider Thanks this. -

Speaking from a Carrier's point of view.....The "shadyness" comes from the fact that most of the general public looks at the door of a rig and instead of seeing the name on the door....The public sees $$$$$$$$$$$
I would suggest incorporating and placing all of your assets into a family trust....
If someone tries to sue...all they will see are zeros beside your name......They cannot gain access to a family trust without spending a lot of their own green.......slow.rider Thanks this. -
What was easiest for me was to have to use the person my insurance agent recommended. It is hard to seperate the scams from the real ones. And last thing you want is to be held up becasue you paid your money and they didn't file it. And you know your agent is going to work with someone that is on top of things because they have a lot to loose on something that costs $50.

+1 on OOIDA. That BOC-3 filing was the first benefit I used and it just about paid for the membership.
