Don't they need residue for 'parafanalia'? Well, it is NY...

There didn’t have to be any actual drugs present. From the article:
“According to the Department of Justice the term drug paraphernalia means ANY EQUIPMENT,PRODUCT or MATERIAL of ANY KIND which is intended or designed for use in manufacturing, compounding, converting,
    concealing,producing,processing,preparing,
injecting, ingesting, inhaling or otherwise introducing into the human body a controlled substance.”
Bongs do process/convert drugs so people can inhale them, therefore as far as the Feds are concerned,it’s a legit bust! Plus discrepancies with the paperwork sent up red flags!

    Badmon Thanks this.

Theres a massive gray area here. I could take an old Sherlock Holmes style tobacco pipe and put weed in it and smoke it just the same. I bet if they found 8 pallets of that they would have sent him on his way no problem. I mean are there absolutely NO head shops in NY that sell little pipes or even bongs?? Doubtful. Makes no sense to me but what do i know im just a truck driver

Well if New York State put the tax on the stuff then maybe somebody will look the other way. Remember about 10 years ago when Tommy Chong was advertising Chong’s Bongs online? The Feds didn’t take too kindly upon that because there wasn’t a tax associated with it! Never mind it was still federally illegal back then!
