So I bought a Lowboy from a guy in Texas and he had the flip neck welded to the rigid neck. I asked him what happened and he said that his driver didn’t put the pin in right on the one side and it had fell out and broke the lugs to secure it.
He said he had it plated because he needed to keep using it and the insurance company was taken too long so he just plated it and kept the money and ran it like that since it wasn’t a big deal to him. I told him that if I buy it, does he know someone that can put it back to factory? He said he knows a welder that could do it, but that he would do it another way because he didn’t like the way the factory did it. I told him I’d rather just order the parts from Kayln and have it put back to factory spec for liability reasons and after I said that he agreed.
When I decided to buy the trailer, I asked him to send me an invoice and I’ll get him paid. I never asked to look at the titles like a ####ing idiot. I’m just used to buying heavy equipment and there not being a title so I didn’t think anything of it. Anyways, he sends an invoice I send him the payment and his wife sends me a bill of sale and copies of the titles. My other Lowboy only has one title even though it has a jeep and booster so I just clicked on it and it was a clear title, except the one at the bottom that I didn’t scroll down to. When I noticed it had a red title, I said you never told me it was a red title or whatever and at that point I wasn’t even thinking about salvage or rebuilt title. When his wife finally sent me the titles I went to the DMV and they told me that I can’t register because it’s a salvage title and I said I thought it was the same thing. I never thought about it.
When I brought it up to him, I said this trailer isn’t even road legal. I can’t even take it out of your yard legally. I said when I noticed it was a red title I thought it was road legal because you said you used it and sent me pictures of using it after being plated. He tried to tell me it is a legal trailer and I can use it. I’m like dude you’re just an idiot and he’s full of #### and knows what he sold me. Just a liar. Then I thought about it and said that you keep telling me that you used it and it was legal. I said you Probably used it up until your registration needed to be renewed and that’s when you quit using it because you could get it re-registered. Which realistically was still illegal for him to use because it wasn’t deemed roadworthy because the insurance company made it a total loss.
His welder never finish welding it for me he wouldn’t give me the welder‘s number so I can ask him you know what’s going on and I need his information if I try to get it rebuilt, but he needs to start all over because it needs to be done by someone certified or someone at least documenting everything to give to the state inspection office when getting it Inspected for a rebuilt title.
I just think it’s almost fraud or something because, he told me it needed a couple tires pumped up, the brakes might need to be broke free from sitting for a while. He never told me that the neck needed repaired. That was my choice to repair it back to you know factory spec.
He sold it to me as a usable, roadworthy trailer with the neck that had just been made rigid. The invoice doesn’t say anything about a salvage title. The bill of sale doesn’t say anything about a salvage title. The listing on truck paper didn’t say anything about a salvage trailer. There’s even a prompt to choose from new, used, or salvage and he just probably chose used.
I’m just screwed I’ve spent $100,000.00 on the trailer and $5000.00 in steel from Kalyn Seibert and I think $11,000.00 I sent him to pay the welder that was supposed to be $75.00 an hour so I sent him $750.00 a day for 10 hour day which it’s not even done after 3 weeks of welding. I don’t wanna go get the trailer and then that’s me excepting that it is the way it is so I’m just I’m letting the trailer sit at his yard since it’s not deemed roadworthy anyway.
Does anybody have two cents to chime in on this or an opinion what you think I should do or is it my problem? I mean I did buy it and I didn’t ask to see the titles before buying it because I assumed they were ####ing good you know but the fact that he sent me the invoice and didn’t send me the copies of the titles until after I paid for it.

Just to offer two pieces of advice
One is get a lawyer asap, don't ***** around at this point.
Have them sort out this mess. The amount of money is justified to bring it to court.
Second is do not ever have the seller arrange for a welder. I have gotten burned with repairs "made" by sellers who just took the money and ran with it.
Oh, and a third, if you are spending that money, get the manufacturer involved; in this case, Kalyn-Siebert should work with you to fix the trailer if you get compensation for the fraud. Otherwise, get your money back, look for another.Diesel Dave, GoneButNotForgotten and JB7 Thank this. -
Take a screenshot and download the Truck Paper ad that shows the title status listed as Used instead of Salvage. That's pretty much all you'll need to win in court. Make sure to get all your other expenses like attorney's fees, travel, office, admin etc included in the suit too.

As for moving it, in Texas you can move road equipment that has not been inspected, and no tags, it’s a temporary permit called someone like a ‘relocation permit’(I think) usually good for 48 or 72 hours. We did it for ‘rig moves’ in the oil patch. Contact Texas DPS. Okla. has something similar.

You CAN register anything with a salvage title after it has been rebuilt. It has to be inspected and checked by DPS for roadworthiness and cleared from theft. Get the proper paperwork and contacts from the DMV. Depending on the area it is located the officer can come out and do the inspection in person or you may have to pull it to the DPS station. Either way it is usually by appointment so it takes time.

Even if it doesn’t have a vin it can be done. Texas will issue a new vin on title with an R as last digit to denote it was a rebuild. It is considered a bonded title for the first 3 years and cannot be resold in that time but will be a free and clear title after 3 years to resell again. It discourages people from just rebuilding something to flip it for profit but allows someone legit to rebuild their wreck after buying back from insurance.
