Broker Detention Scam

    I was thinking that perhaps detention could be regulated by some governmental agency having enough reach over carriers and shippers/receivers - can't think of any - probably there is none, anyway. On the other hand, something tells me that this could cause even larger screw up, so it is best left to the market. Libertarians would say it is nothing but pure logic. For example, if there was such a regulation, the businesses in the long term would opt more for drop&hook set ups, which would benefit mega carriers. I never even consider loads where their say "drop trailer for 48 - 72 hours", I can't afford it on consistent basis.
    The terms and condition should be negotiated and fought for by the carriers themselves. With the truck abundance, the Carriers position to negotiate may not be too good.

    The question remains of how this should be done properly. Often, especially with large entities, the very Broker-Carrier Agreements, especially those automated and done online, do not even leave any room for detention amendments.
    Sneaking in a stamped list of your own terms and hoping that they would honor it may not be enough when it comes down to a dispute. They should acknowledge that they agree with it by signing it and sending it back. Any of you do it like this, or you just discuss your terms over the phone and after hearing them say "OK...Fine!" you just put down "Detention: $75.00 after two hours, no time limits" and you never have any problems collecting?

    I like JB hunt, after 2 hrs 50 per hour, I was at Miller Coors 16 hrs, on got paid for 14 HR,

    So obviously, they don't have any time limit. If that's that case, $50 ain't bad at all. They made it easy lately by simply updating you shipper arrival/departure via their app and noting time on BOLs.

    We have too many laws as it is. No need for more. The problem is the Carriers not operating a BUSINESS like a BUSINESS. If the terms aren't signed by both the Carrier and Broker you'll have a hard time collecting it if things go South. It's a contract. Period.

    What he described is extreme. It never happened to me yet. Trust me, collecting $700 while sitting on ### the whole day (especially including night hours) is quite appealing to some - including myself at times.:D
    So many times, I was sitting even longer at a truck stop, waiting for the next day pick up or delivery...uncompensated.

    I don't know what it is about the beer companies but they do tend to tie you up, although that is Extreme.

    I would be very happy with $700 in that scenario because there's no fuel burned there's no wear on the tires, and there is no arguing about it.

    This subject, and TONU are the two things that I am most concerned with in getting my authority and I'm trying to find whatever ways there are to deal with this.

    If you knew you were going to go from point A to point B in x amount of time I don't think it would be hard to be profitable. The problem is how often is it going to happen that you are tied up and not compensated for it or they cancel the load and try to give you some lousy amount.

    I'm not afraid to negotiate with anyone, and I'm not afraid to cross things out and put my own terms in. But being a new carrier I have no idea what I can get away with and how much of that is going to have me sitting making nothing.

    I have own authority from 94 and I don't use it and have not used it in many years, the guys that makes it these days, are refer, hot shot, are pulling in op which is salvage cars, the next best thing is to get with on ok carrier and hope for the best,
