so here is an update on this mess. the broker closed her business on may 16th. I called her surety bond, and they dropped her a month before that due to excessive claims. she changed her phone number. but hers the odd thing. she called me at least 5 times, to let me know her number changed, to let me know that she mailed the checks, she even went over the invoices with me, and gave me the totals of the checks that were being mailed. she called me... i didnt call her, she called me SEVERAL times.. and now, the checks never showed up, i have gotten a hold of her a few more times, and each time she says she will have to call me back.
we just started this bizz, and were running red before this, and now that 1/3rd of our income just... is gone. we have no choice but to shut down and sell the truck.
this is BS.. how can this even be possible for people to do? we hauled a load for her, we had a contract for payment, and she just skips town? and there isnt crap we can do about it?
OOIDA said to file against her bond.. well cant do that... OOIDA said to post a complaint on the load board we got the load. WHAT GOOD IS THAT GOING TO DO!?
at least we got to experience trucking for a few months anyway...
so is there any advice out there? She is/was an LLC, we could sue, but that doesn't save our trucking co. cant get a hold of her my phone anymore, i sent some letters and they were returned to sender. I just cant believe its this easy to screw over someone.
and to think, she used to call me every other day to see if we could haul loads for her, thank god we were unavailable to haul on those days....

So here is a question. How do you report a broker for non payment of truck ordered not used. I had a pickup in Savannah ga I dead headed from Melbourne Florida to pick it up. Pickup time was by 300pm called shipper they were cool with me getting there at 315 showed up finally at 322 they were still cool waited until 405 pm and that's when they told Me the load was still on a container and would not be ready until tomorrow morning. Broker is refusing a Tonu because I was not there by 3pm. This is a serious problem with most brokers we have in America. They are capitalist thiefs and I'm sick and tired of being taken advantage of. It's just a back n fourth lie over the whole ordeal. I ended up calling the shippers main office today and they had actually called their customer I was picking the load up for and told them the load would not be ready any help US appreciated

Was there a tonu clause on the rate sheet? Or a general one in the contract you signed (broker packet) when you started using them? If not, then you have leg to stand on. If so you file on their bond just like with any other load.

Well, considering this thread is 9 years old and the last was 2 years ago, if they haven't been paid by now, they are out of luck.
