    Im not worried about 15 minutes over on HOS or 1,000 lbs over on an axle. In fact on weight I rarely look at it unless it is significantly over on gross. Just the other day a grain hauler was delivering within the city. He was 92K with no permit (max of 80 legal). I handed him back his paperwork, told him to make sure he got a permit before coming thru that heavy again and I drove away.

    This particular truck that the entire thread started over had an excavator that was almost 37K set over a set of tandems. I never weighed it or noted anything on the inspection. In fact on that day I only performed a level 2. I figured he had enough problems to fix (including needed a federal annual on both units). Besides I was wearing my knee high leather motor boots.....I know I can hear the cat calls already.

    On the original truck, if you noticed a past history of violations, why would you not do a Level 1 and go over everything with a fine tooth comb?

    I would say, as an opinion, that's the type of junk equipment and drivers that need pulled off the road. If the company hasn't learned its lessons by now it likely never will.

    All of the past inspections were on other equipment. This was the first inspection for this piece of equipment. That said this is a local construction company and it was the owner driving. We had a long conversation about liability and we have already set an appointment for me to go to their yard and review ALL of their equipment.
