California Bans IC's

    California supreme court voted today that transportation companies cannot use IC's in California.

    ROFLMFAO

    Ruling is if they are dispatched, they are not IC's.

    If you force dispatch me to go to a certain location at a certain time that I am not willing to go, and if I don’t go, I will be terminated. So am I an employee or IC?

    In my opinion, an employee.

    But who knows how lawyers will spin it.

    There are lots of IC'S that are dispatched, that are allowed to turn down loads. Does that void the whole concept?

    Yes, because those ICs would be considered self dispatch because they can choose their own load.

    I’ve been working and talking to many Landstar BCOs about working 1099 and self dispatch, but most are only interested in forced dispatch because they want to work with their own favorite agent and choose my route and load is not an option. What’s up with that?

    The loads you choose are directly related to the revenue of the truck.
    If I were in that position I wouldn't let the driver dispatch themselves either.
    Especially if I already have good/ great relationships with good reliable agents that I can trust along with good rates.

    Exactly. If that’s what you wanted to do, then, it’s forced dispatch and you are actually hiring an employee, not IC. If that’s the case, you should be honest and say that you are looking for an W2 employee and the job is forced dispatch and the employee will go where you tells him to go. No insubordination.

    Good luck finding anyone dumb enough to work for you though.

    I was trying to explain to you why they won't let you dispatch yourself.

    Well I can't believe it...
    Am I actually in agreement with something coming out of Cali politics???
    Well, however it happens, this 1099 related driver abuse needs fixed for sure.
